    Default newbie needing help with reclaiming charges from llyods

    hello i am trying to work out if i can claim bank charges back from an old llyods bank account i held about 4 years ago
    as i have not paid this for a number of yeas the debt is now sold to a DCAicon.....however the debt is just under 700 over the course of me having the account i believe they took around 500-600 in charges hence why i went overdrawn in the first place.
    i understand you can send a s.a.r and get 6 yearsicon worth of statements but the only issue is as the debt is now with a dca do i send the s.a.r to them or llyods
    and as it was so long ago i dont remember my account number is this going to be possible to reclaim or is it worth my while just to pay it off?
    any help would be appreciated as i really am vague on these issues

    When they sell a debt off to a thurd party, they pass on the rights in th eocntract - but not the liabilities.

    Serve the SARicon on Lloydsicon and begin the claim against Lloyds as well.

    Do begin the county courticon claim as once Lloyds have asked for the claim to be stayed - as they surely will, then you will have a basis for telling the DCAicon to push off as they sould not be able to pursue you on a stayed claim.

    In fact when the application for the stay is made, you should be able to ask the court for an order to Lloyds to instruct the DCA to stop.

    thanks are you able to tell me how i go about dong these things also as i dont know any account numer will it cause a problem?

    Subject access requesticon under the Data Protection Act 1998.
    Please supply me with a complete list of transactions and charges relating to my card history with (name of company). Alternatively, a complete set of statements that include all transactions, late payment fees, over limit fees, all interesticon & charges for that period will be acceptable. In addition please supply copies of any default notices issued in this period & any other documentation or information pertaining to me that you hold in your records.

    Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my business with your company.

    If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response.


    If this account has been sold or otherwise transferred to another organisation for administration or recovery please supply details of the sums notified by (name of company) to any such organisation & a signed true copy of the Notice of Assignment. Please state whether this was absolute or equitable.

    I enclose the statutory maximum fee of £10. You have 40 days in which to comply.

    Hi,

    The account number should'nt matter, give them all the info you have on yourself when you opened the account, address ect.

    That should be enough for them to search their records for what they hold on you.

    In the Subject access requesticon cas93 has provided change the word CARD for ACCOUNT.
