Hi. Yesterday (Sat 31st Jan) I agreed to buy a new ford fiesta with a main dealer at January's prices (Ford is increasing its prices on Monday 2nd Feb). The car was going to be factory built and delivered in March.
I signed the Retail Order form (contract to buy) left a £1,000 deposit and went home. At 8:30 the same evening I had a phone call from the dealer saying that they couldn't 'amend' the car for the price agreed. I kept pressing him to speak in plain English and he admitted that he meant they couldn't build the car at the old price. I asked if that meant they were cancelling the order and he said yes and could I come in asap with the order form to have myu deposit refunded.
Can they do this?? I'm sure I couldn't back out of the contract like that if I found out I couldnt afford the car. Please advise. Thanks
It would depend on what it said in the contract that you signed.
I would suspect that the dealers have had this problem before and that the contract does give them the option to cancel if such a problem arises.
However I would read through the contract and see if there is anything that refers to your situation.

You should do as the doc says, but I'm a bit sceptical. Car sales have reach rock bottom, they have asked the government for help here and in the US, and they are upping the price and want you to pay more, mmmm.
You could ask for a stock model and a big discount. If you don't get it, go somewhere else and see what sort of deal they can do for you. I certainly wouldn't bow to pressure. They probably think you will agree to the increase.
It's a buyers market at the moment.

The contract says ' The retail customer's order for a new vehicle is protected against against the effect of manufacturer price changes, subject to the provisions of Ford's Customer Order Price Protection Plan.'
Which says 'Ford's Price Protection plan means that the price you pay is the same as the price on your order, as long as you are prepared to accept delivery within 3 months, and in any event, as soon as your vehicle is available. Ford motor company is not liable for changes in price caused by government changes in tax.'
They didn't ask me to pay extra the man just said 'we cant amend your car for your specification' (A factory built Ford Fiesta in silver with ESP - hardly a difficult order). When pushed he admitted it was because they couldn't build it at the old price. A bit confusing.
The salesman agreed the price and contract, his line manager (the compliance manager) agreed the deal, and whoever the compliance manager spoke to at Dagenham Motors Headoffice for 10 mins agreed it also.

So instead of and increase in price, it should have a reduction to account for the drop in VAT.
You must point this out to him and tell him that he has to stick to the contract made or you will seek compensation, through the courts if nec.
