Lloyds TSB loans CCA - help please!
This week we have rather belatedly sent off 2 CCA requests to Lloyds TSB regarding a pair of unsecured personal loans taken out by my husband (Nov 2004) and myself (Feb 2005) in an attempt to finally sort out our badly managed financial situation - see my introductory post in the Welcome forum.
These loans are still running, but we can find no paperwork - credit agreements etc - relating to them.
The thing is, having spent days reading and inwardly digesting as much info on this great site as possible for my feeble brain, we have sent off the CCAs but didn't mention anything about PPI in them.
Mainly because I forgot, but particularly in my case, as I believed I didn't take out PPI because I was a stay-at-home mum/housewife at the time of application, yet a letter found by chance today states that I do indeed have PPI. Sounds like a possible case for mis-selling???
This means I don't have either the loan agreement numbers or any figures regarding how much PPI exactly we have been paying.
Now, does anyone know if this will automatically be covered in the CCA info they (hopefully) send back, or if I should send a separate letter to Lloyds asking specifically about the PPI relating to these loans?
I'm sorry to be a pain, but am going round in circles trying to work out if I'm doing it all correctly, lol!
Welcome to the PPI forum I read your welcome message and posted there that i would be looking out for your threads.
Firstly can i ask when you requested the cca's did you include the £1 fee
This should show the PPI but what you have requested is just a copy of the agreement.
If you wanted to see everything the bank hold on you the way to do it is to send an S.A.R letter there is a £10 statutory search fee and it can take 40+2 days to get the requested info from them.
Have you read the sticky threads at the top of this PPI forum loads of useful info there.
Now for a couple of tips being as this is the first of many threads
1. PHOTOCOPY EVERYTHING so for shouting but it is a very important one
2. Send everything recorded and keep the receipt in a safe place as it may be needed later.
This is the S.A.R letter to get all the info from the bank just copy and paste into word and edit to suit your needs:
I understand that you currently hold details of my personal and financial information within your internal record systems with regard to personal loan accounts And or credit cards
Please supply me with a complete list of transaction and charges relating to my history with your organization, INCLUDING Loans and or credit cards, payment protection insurance and other products. Alternatively a complete set of statements for the accounts or associated accounts is acceptable. I would be grateful if you would provide the following for ALL accounts or associated accounts I have held with your organization:
-Full copies of all contracts which you believe exist or have existed between myself and your organization, including true copies of any documents you hold in support of the same.
- A complete list of all transactions or statements relating to ALL of my Loan Accounts and or credit card with your organization.
-Copies of all documents which include any of my personal information including copies of any contacts or invoices, emails or computer records containing my personal information, or any records which pertain to this information.
-Full copies or transcripts of any correspondence in postal, email or any other format which you have entered into with any individual, organization or third party which contains my personal or financial, or which pertains to me.
- Where any previous information or records held have been deleted or disposed of, the methods used to do so, including dates, certificates or references confirming details of destruction. Where you are unable to provide such certificates, please provide a declaration, signed by an authorised officer of your company, confirming the dates and methods of destruction of this data.
-Full hard copy print outs of my personal or financial information, held in a digital, magnetic or any other format which is held in any archives, backups or other storage devices / locations.
I enclose a cheque in the sum of £10 to cover your fee.
IF YOU UNABLE TO DEAL WITH THIS REQUEST, YOU SHOULD IMMEDIATELY FORWARD IT TO THE PERSON WITHIN YOUR ORGANISATION RESPONSIBLE FOR DATA PROCECTION.
I look forward to hearing from you in the first instance of receipt.

Hi again Pompeyfaith and thanks for taking the trouble to read my post!
Yes, we did enclose the £1.00 postal orders for the two CCAs.
We have Subject access request'd Lloyds for our joint account (with the obligatory £10.00 postal order fee) - will this definitely show up all the loan stuff then?
I assumed it would only show stuff related to day to day running of our account, not loans specifically - sorry if I'm being thick here!
I've read a lot of the sticky threads, but it's just a matter of there being soooooooooo much to take in at the mo.
We sent all letters recorded and have kept the receipts - checked this morning and the CCAs had arrived, but the Subject access request had not yet.
We've made duplicates of all letters and are keeping a diary of times sent, time-scales for responses etc.
We are also chasing MBNA to see if their credit card agreements are enforceable/PPI was mis-sold (have sent CCAs and Subject Access Request last week) and will be attempting to get something back from Swift Advances (some hopes, I know!) for their extreme charges/PPI and will be posting messages on the relevant forums soon.
In the mean time I will keep reading and trying to acquire as much knowledge/ammunition from here as I can manage.
Hiya Again Landy the S.A.R will show up everything they hold on you,they have a duty under the data protection act 1998 to supply this info if they don't a complaint to the Information Commissioners Office in in order.
If you put in the SAR that this is relating to all loan account then yes that is what they have to supply.
The timescale to allow them to do a search is 40+2 days 2 being to allow for postage if in this time you do not have what you requested, its time to send a non-compliance letter and put the account in dispute.
The response to the Subject access request will depend on how you worded it. eg first one I sent to Lloyds just asked about details of charges or copy statements relating to one specified account and I got a 3 page list of charges. If you sent the one Pompey has posted you should get absolutely everything they hold on you
It also depends which address you sent it to - they have a compliance team who are alot sharper than their complaints department -
actually come to think of it speed humps are sharper than Lloyds complaints bods as you will find out further along you journey
If you can keep you head when all of those around you are losing theirs try parking your helicopter somewhere else
That is a very good point redvixen Re correct address Landy if you go to the Lioyds bank forum at the top in the stickys you will see a post headed contact details in there you will find correct addresses to use.
You are looking for Data Controller who is the person assigned with the task of dealing with data protection issues.

Hi Redvixen and Pompeyfaith,
Thanks for all the info - the address we sent the Subject access request to was the Chatham one (Compliance dept).
Unfortunately the letter (although a template from here) was less specific, obviously more like the one you used first, Redvixen, asking for 'a complete list of transactions and charges relating to my banking history', so I guess this will not not show up the loans then - doh!
Do you guys think we should just wait to see what kind of response we get in the specified time or do we need to send another letter(s) relating specifically to the loans?

Don't worry yet - I sent the banking history one to a different address to the chatam one and with a specific account number on it - banking history should cover everything - a loan is a transaction isn't it
And you are not a pain - there is a lot to learn at first and we all started as newbies
