    Default car clamped no tax

    Help,

    I sold my car which has been off the road for 6 months for spares and repair on december the 21st he also paid for the car and filled in th V5, the guy who brought it asked if he could collect it after the christmas hoilday which i had no problem with as i was away at my parents until 15th of january but did insist it was gone by my return as i needed my drive back. I came back to check my house about the 29th december to find the car had been removed from my drive and now parked in the street with the a slighty better set off wheels and tyres on and could see the stereo had been removed. and the bonnet was not fully closed so had a quick nose and could see the diesel pump had been removed as this was why the car had been taken off the road and the battery was missing.
    other than that i had no concerns, Then when i returned on the 15th on I was pleased the car was gone but this was shortlived as when checking my post I had a letter from the DVLC about the car has been seen on road with no tax and it has been clamped on the 4th jan giving me the chance to get the car back by paying a release fee, which i thought the car dont belong to me any more so why worry, two days later i got a letter which says that if pay £273 by the 1st febuary they will not take me to court.
    where do i stand as i don't think i have done anything wrong. I have tried to track down the new owner and the address he gave me is false.
    So what should I do?

    I posted the V5 on the 29th when i saw the car on the road.

    I would write to them once only and inform them that you sold the vehicle on 21st December and forwarded the completed V5 to notify change of keeper shortly after that. At the time the vehicle was clamped on 4th Jan, it was no longer your responsibility and they should pursue the new owner. Further point out that since you are still within their self-imposed 4 week deadline for receipt of acknowledgement of the change, you do not yet have it.

    Finish by saying that you will not be accepting their offer and will ignore any further communication in the matter other than a notification withdrawal of the penalty or a Court summons.

    It would be helpful if you have a copy of the receipt etc. that resulted from the sale.

    I would also ring DVLA (using a number from saynoto0870.com rather than the 0870 number) and ask why you have not yet received your acknowledgement letter and ask what date are they showing for the transfer of keepership.
