My husband was laid off from his job last week. We had taken out PPI on our bank loan but have been told we are not covered because he was working for an agency at the time of taking out the loan. When taking out the loan we were asked if we were both in work to which we said yes. The loans advisor checked out bank statements to see a wage was going in every week for husband and every month for me and agreed to the loan. We were never asked about out jobs. I have since read the PPI paper work and it does not cover for temporary work ( agency work ). My husband is in the construction industry and moves from one firm to the next as and when required. What are our chances of getting this sorted? I feel we were misold the PPI but don't know where to go next. Please can anyone advise???????????

Can i first advise that you start your own thread in the PPI forum as it will be easier to follow your progress and advise you that way soon as you have done that i will be along to get you started.
May also be a good idea to have a read of other posters threads to give you an idea of what is involved and what is likely to crop up.
Now that is out of the way do you have a copy of your agreement as this will be needed if you don't not to worry i will explain in the next paragraph how to get this.
You will need to send a S.A.R letter to the lender ill post a link to a template letter below that you can use just edit it to suit your needs when you have this letter ready enclose the £10 statutory fee for them to search their records i would use a postal order and write on the back S.A.R FEE ONLY.
Also send this of via recorded or special delivery and get and keep safe the reciept of postage you have to allow 40+2 days for a reply so mark on a calendar when you posted it and count down the days.
In the mean time browse this forum and pick up as much info and tips as possible.
Once you get your agreement post here and we will go to the next step.

Here you go just copy and paste this into a word program if you dont have one of these open office is a good one that is compatible with microsoft office and its free too.
As i say once copied and pasted just edit it to suit your needs.
I understand that you currently hold details of my personal and financial information within your internal record systems with regard to personal loan accounts And or credit cards
Please supply me with a complete list of transaction and charges relating to my history with your organization, INCLUDING Loans and or credit cards, payment protection insurance and other products. Alternatively a complete set of statements for the accounts or associated accounts is acceptable. I would be grateful if you would provide the following for ALL accounts or associated accounts I have held with your organization:
-Full copies of all contracts which you believe exist or have existed between myself and your organization, including true copies of any documents you hold in support of the same.
- A complete list of all transactions or statements relating to ALL of my Loan Accounts and or credit card with your organization.
-Copies of all documents which include any of my personal information including copies of any contacts or invoices, emails or computer records containing my personal information, or any records which pertain to this information.
-Full copies or transcripts of any correspondence in postal, email or any other format which you have entered into with any individual, organization or third party which contains my personal or financial, or which pertains to me.
- Where any previous information or records held have been deleted or disposed of, the methods used to do so, including dates, certificates or references confirming details of destruction. Where you are unable to provide such certificates, please provide a declaration, signed by an authorised officer of your company, confirming the dates and methods of destruction of this data.
-Full hard copy print outs of my personal or financial information, held in a digital, magnetic or any other format which is held in any archives, backups or other storage devices / locations.
I enclose a cheque in the sum of £10 to cover your fee.
IF YOU UNABLE TO DEAL WITH THIS REQUEST, YOU SHOULD IMMEDIATELY FORWARD IT TO THE PERSON WITHIN YOUR ORGANISATION RESPONSIBLE FOR DATA PROCECTION.

They have 40days to comply under the Data Protection Act, but do be nice and allow some time for postage. Which should always be by recorded delivery, so you can prove that they did receive it.
Thank you for your help and for getting back to me so soon. I am feeling better already. I am going to act on this matter quickly. Am I right in thinking it is better not to cancel my PPI whilst I get this sorted? What will happen if I cannot make the loan repayments?
