Help please, husband has been laid off work and cannot find any employment, he is self employed and we are homeowners. We cannot pay our Barclaycards and wonder if there is anything we can do to help ourselves other than go to debt management solution.
You could contact Barclaycard and explain the situation, ask for reduced payments, they might even stop the interest, i got such an arrangement with them in 2001. If you havent already done so, cut all the credit cards up.

Dont get into any conversation with Barclaycard about being a home owner,credit cards are unsecured debt, ie your home is NOT secured on the debt, if you were to take out a loan secured on your home to repay the credit card debts and fell behind on the repayments, then your home would be at risk.
Hi thanks for your thoughts, the problem is that until my husband finds work we can only afford to pay the mortgage and essential bills to keep us going there is no money for creditors at all. Someone has told me that you can ask for a your credit agreement and see if the debt is enforceable and I need template letters or something to ask in the right way, so far we have not missed any payments but now is crunch time, no money left!
They have had their 14 days but I have not received anything from them yet. Do I need to do anything. I have been receiving automated message from Barclaycard at least 5.
roko, if you go to the dealing with debt in Scotland section and go to my thread, CCA request reply from Cabot, you will find the follow up letter account in dispute.

I did have a telephone call from them last night, saying they were calling to discuss my account and take a payment on a debit card from me!
I said I would not talk to them because I was awaiting response to my letter asking for a CCA and until that was received there was nothing to discuss with regard to payment.
I have written 2 letters to them on the 7th Feb and 6th March. This has now been received on the 16th March but dated 13th February!! I have removed my details from the letter but as you will see there is no signature anywhere this is just a blank and a very poor copy. What do you think? Is it enforceable in any way. I am getting severe hassle on phone now by automated calls and call centre staff.
It does not look like a valid CCA to me roko, the only signature box i can see is for cancelling the agreement, i dont see any provision to sign the agreement, how old is the account ?.
Blueda, Not sure exactly how old it is but I have a Jan 2004 statement, but destroyed the previous years, so its quite old, I would think probably from about 2001. They have just been on the phone to me again and I was going to be put through to someone in Disputes and the phone when dead when I started telling them about the letters I needed responses to and so far they have not called back! That document is not enforceable in court. Keep writing to them requesting a true copy of the agreement that you/your husband signed. Mention in your letter that you will only correspond in writing and will not accept telephone calls from them. When they next call, refuse to answer the security questions.
If you are not comfortable about this, then I would get in touch with the CCCS. Barclaycard will leave you alone if you get on a dmp.
I'm going to send a harrassment letter today to stop them ringing me, hopefully this will work. In the meantime, you, smt37, state that the document is unenforceable can anybody else confirm this???
My reasoning is because, in court, they would have to produce the signed version and the only place to sign on what they sent you is the cancellation form. It has nothing about you on there, so how do you know it's yours?
