    Default Faulty BMW

    Dear All

    I hope someone can help/advice me.

    I bought a brand new BMW special edition model in May 2006. The car drove well for about 6 months until the winter months started. During cold weather the car would not start. I reported this problem to BMW in Watford and was advised to bring the car in. They checked the car and could not find any faults. During the subsequent few months the problem persisted and I returned the car once again, only to be told that they could not find the fault.

    In the winter months of Dec 07 to Jan 08 the problem reappeared and I returned the car. Once again they did whatever they had to and could not resolve the issue. they told me that this was an apparent issue with the new limited model I had purchased and BMW in Germany was looking into it. At that point I told the manager that I was not impressed and should the problem be not resolved I will want to return the car.

    Since Dec 08 the problem re-appeared and today was no exception, except the car refused to start at all. I called the BMW and was advised to call out the emergency recovery team. They arrived and resolved the issue by "jump starting". This has not solved the on going problem. I have phoned the BMW garage and book the car into to be looked at next week. However, I am now at a point that where this car has gone back to BMW 4 times and this issue has not been solved. I want to return the car...so that they can give me a replacement or "buy" it form me.

    Can anyone help as to what my rights are and where I stand with this issue?

    This is not meant to be flippant! They have admitted there is a problem. A vehicle is meant to be driven, you are unable to drive it much for the reasons you give, therefore it it not fit for purpose. Get your money back and buy an Audi

    Trilby this is easier said than done
    I had a similar issue with Audi who admit the fault, sent it to Audi Germany..and gave the car back in their own words "unfixed and manufacturer defect"

    It took 9 months and a £3500 payout from me to Audi to give the car back - + 9months of £525 a month I had already paid

    To be honest, Audi got away with it but anyway...there was a bit more to it

    I agree though, as far as you should be concerned, not fit for purpose...heck you cant even start the damn thing

    And a problem with the "limited edition" model?? Surely the limited edition potentially just as some body kit and styling rather than complete engine/mechanic changes?

    Have you tried another dealership? I have never liked the bmw watford one (or any other dealership in watford!) to the point I was put off BMW for life

    I have a similar problem with a 335i SE which I bought in September 2006. This is the new twin turbo model. After about 1 year the power kept failing on long journeys.

    I called Mundial out at home and they could not identify or fix the problem. The car continued to break down on long journeys, but the problem cleared when I restarted the engine.

    Then the real breakdowns started in August last year. The car went in and had a turbo changed. It broke down again and the fuel pump was changed. It broke down again and the Injectors were changed.

    In Jan on the 12th it broke down again and it is still in the garage being tested.

    The garage has offered me £10,000 off the price of a new vehicle. But guess what?
    I paid 45k for the car and the outstanding finance is 24k. They say the current value s only 14.5k, so the 10k 'goodwill' contributionicon will just about leave me clear but ONLY if I buy a new car!

    Tragic isn't it.?

    I am currently driving a 118d of the garage's and have just emailed them to tell them I want my money back.

    Pigs might fly! but I will let you know what they say.

    The situation with my BMW has gone from bad to worse.

    I have written to the Finance Company - BMW Financial Services, BMW (UK) and Blue Bell. stating that I wanted to hand the car back as I have not seen or driven it now since 9th January.

    I have asked for £5000 compensation, my £4500 deposit back and the refund of payments from December 16th 2008 to March 13th 2009. (The March 13th payment I cancelled.

    They have refused to do anything more than offer me £10,000 off a new car - an offer that is now worthless.

    Futhermore the car that Blue Bell leant me, the 118d, now will not open so assume they have a remote way of disabling it.

    Consumer Direct have a website www.consumerdirect.gov.uk so I called them 08454 040506. They say I should write to BMW Financial Servces again and give them 7 days to offer a remedy quoting the Supply of Goods Implied Terms Act.

    To be honest I doubt very much what good that will do as everything has been negative from them so far.

    The only other recourse apparently is to find a solicitor and sue them but I neither have the time or the energy to do this.

    Apart from ranting and getting high blood pressure is there anything else I can do?

    How can these people sell me a car that is off the road for three months, expect me to pay the installments and get away with this.

    ASt the very least if you are considering buying a new BMW then note the peopl einvolved - I I'm afraid may just have to take the effing thing back again.

    hi mate

    sorry to hear your troubles... same here... I too spoke to consumer direct and wrote them a letter giving 14 days...they replied after 22 days stating there is no point indiscussing the matter further as there are no issues with the car.

    i am going to keep plugging at them until they get fed up.... in this day an age bmw seems to think that they can act like a gang of thugs....

    Hi Chappr,

    Firstly, they hadn't disabled the car, mrs niggle put my old keys on the board so I was using the wrong ones!

    Anyhow - apparently I have a 'select' agreement which means I can give the car back and thats it. I lose my £4500.

    The only compensation is 10k off a new car so maybe the best thing to do is but the smallest model for my wife and get 10k off it???

    The bottom line is I get a real £5500 off a new car which in these times is pretty easy to negotiate depending on the price of the model.

    Not ideal as its another commistment to BMW who have behaved badly from all sides in my opinion.

    The stupid thing ism is that if just one person reads this thread they would be put off buying a BMW so surely keeping people like us happy is really really important.

    I really don;t have the time or the energy to fight this but I agree with your comments, they rely on this and get awy with it.

    The thing is Chappr they don't give up, they just ignore you! my last email and the last letter I wrote was just ignored. The only option is to take legal action, maybe then they would back down.
