Smile Am I going to court...?

    Hi Everyone,

I have been in correspondance with Creation Consumer Finance regarding an hp agreement and the PPIicon connected to it. I believe the policy was mis-sold as I didn't realise I had it and it was only when I came across the paperwork i noticed, also I have a pre-existing medical condition which would not have been covered in the event of a claim.

I have written to them and had the usual "We believe you had all the correct information at the time....etc" so I replied with a letter before actionicon, they have not acknowledged this letter and time is up!

Becasue I signed the agreement in 2004, it is outside the fosicon regulations so I guess I need to start the court preceedings??

Can anyone help me with the next step?

    Thanks in advance

Have you phoned the fosicon just to check that it is outside their remission i ask because im under the impression that if the agreement went into 2005 which it did in your case they could still deal with it.

So i would get this verified first before you go down the court route

    FOS Numbers below:

    consumer helpline

open 9am to 5pm, Monday to Friday

    • 0845 080 1800
(calls cost up to 4p a minute for BT customers – but are likely to cost more if you use another phone provider or call from a mobile phoneicon)
    • 0300 123 9 123 or 020 7964 0500
(these numbers may be cheaper if you use a mobile phone or a phone provider other than BT – and will be "free" if you pay a monthly charge for calls to numbers starting 01 or 02)
    Regards

    Hi. Thanks for your help.

I have spoken to the fosicon and they are unable to help with my complaint as when i signed th agreement it was proir to 2005.

They put me in touch with the FLA but I cannot get an answer from them, I have left several messages on an answer machine but to no avail.

Anyone got any other suggestions other than court action?
