Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
This is my first post and after reading around, would really appreciate some advice.
I took out a Barclaycard 4 years ago as I needed it for work( I had to travel and expenses weren't paid until payday). Two and a half years ago I had to leave my job to become my wife's full time carer when she became ill. I haven't used my card in a long time but my credit limit isn't going down much and financially I cannot afford the minimum payment and due to this can't always pay on the exact day so charges keep going on, I sought advice from the CAB who told me to do a financial statement, which showed a £150 defecit in my income(which now comprises of benefits, tax credits and dla) , all my other creditors are happy to accept the £1 monthly payment and have stopped interest charges, but Barclaycard won't budge and just keep piling on interest and late charges.
Barclaycard are totally unreasonable - you can't pay what you don't have. Someone on the site with much more expertise than me will help you here, and give you a step-by-step guide on what to do.

Well before going to the CAB(in November) and being advised not to make payments, my balance was £3200, now it is £3609.16, I am getting overlimit charges and late charges on top of the interest.

All penalty charges on the a/c can be reclaimed, late pay't and over-limit chgs.
This can be used to reduce the balance owed on the a/c. Depending on the figures, it may even bring the a/c balance back down below the a/c limit and stop further over-limit fees. Read the Reclaiming Guide at Link No1 in my signature below. Prepare an SOC (shedulle of charges) and send it off to BC with this letter - http://www.consumeractiongroup.co.uk...RD-letter.html
Also write a separate letter to BC using one of the ones mentioned earlier asking for them to stop adding int't and charges and to accept reduced payments. Tell them you will provide a schedule of Income & Expenditure if required.
As a new site user, you may find this a bit hard-going at first but this may be a better approach than the CCA request, which BC are currently side-stepping.
The upshot is that, if they can't produce a valid credit agreemnt for the a/c, you can repay the debt at a rate you can afford and they cannot add charges and interest, nor can they get a court to enforce the debt.
