    Default Time to go after my PPI

    I have recently posted in these forums about issues with HSBCicon and my req to them for my CCA. I have not received the CCA from HSBC and so I will start a new threadicon to avoid confusion

    My recent thread is here

    I originally applied to HSBC for repayment of PPIicon which they then uphels and offered me £2.5k, I didnt accept and instead applied for my CCA on 3 accounts, none of which have been given

    I am now placing these accounts into dispute

    What I want to do now is go back to HSBC and request that they refund my PPI as this seems to me to be a seperate issue from the disputed accounts.

    I'd like opinions on this please and advice on how (or what letters) to use to claim my PPI (which the HSBC have admitted in writing to me that is due back to me)

    I originally applied to HSBC for repayment of PPIicon which they then uphels and offered me £2.5k, I didnt accept and instead applied for my CCA on 3 accounts, none of which have been given How did you request the CCA on the accounts did you cite the Consumer Credit Act 1974 when you requested the CCAs. I am now placing these accounts into dispute This move will result in a total shutdown from them but you are right to do this if you feel you are in dispute.
    What I want to do now is go back to HSBC and request that they refund my PPI as this seems to me to be a seperate issue from the disputed accounts. You will have a fight on your hands IMO to claim back PPI when the accounts are in dispute due to the lack of CCAs and IMO you should fight the issue of no CCA accounts in dispute as a separate issue to PPI mis-selling

    I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

    Bank charge successes:
    Halifax - Full settlement incl interest.
    HSBC - Settlement, goodwill no admission of liability about 75% of claim.
    RBS - Settlement, goodwill no admission of liability about 70% of claim.
    2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
    PPI Successes
    PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
    2 claims settled in full with LV without FOS involvement.
    2 claims settled in full with HSBC without FOS involvement

    PPI Claims ongoing with:
    Cap one Now with the FOS
    Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
    LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

    1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

    Please do not PM me for advice as it may be sometime before I can respond.

    Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

    I applied for the CCA's with a template from this forum and to be honest, I dont really expect to get anything moving in terms of my PPIicon for a while, but why wait? you don't get if you dont ask

    And if the tables were turned, I'm sure the bank would hit me with everything they have

    I guess I'll see what happens and take a step at a time

    Hello julian,

    having had a quick scoot through your other thread I would suggest the approach to adopt (your choice at the end of the day) would be to write to them pointing out their failure to comply with the Consumer Credit Act 1974 and the Data Protection Act 1998. Inform them that you now intend to lodge a serious formal complaint with the Financial Services Authority, Information Commissioners Office with regard to their failure to comply with the acts and that you also intend to lodge a complaint with the Financial Ombudsmanicon Service with regard to claiming back your PPI premiums, the interesticon charged on those premiums and a statutory 8% interest.

    also, as I sent 3 x CCA req's, should I send complaints seperatly or in one letter giving 3 account numbers

    Actually, I think I need to dend the intended letters of complaint

    as for the refund of PPIicon, The HSBCicon have already written to me to say they uphold my complaint and are (or where) prepared to refund these payments including interesticon, so This is to me at least a rock solid admission by them

    What I need to know is, now the accounts are in dispute, do I simply write to the office dealing with the PPI and request they pay me these agreed monies seperatley before I go ahead with further action?
