    Default Toyota ... please help

    Hi Guys , desperate and need help ,i have a Toyota yaris on an 2005 plate the finance for the vehicle is in my mothers name and i am the registered keeper .On boxing day my mother passed away and now my problem begins i informed toyota financial services that my mother passed away and i had to wait for them to write to me with their decision .I have been informed as i am the registered keeper it has to go in to my name ,i dont have a very good credit history so really out of the question but i tried it with my father as guarantor and it was rejected .They have said it cant go soley in to my fathers name as he no longer holds a driving licence and to purchase a car from toyota you must have a driving licence ......my mother never drove !!!!!!!! .I have 15 months left to pay on the vehicle out of the 5 years so i believe the car is more mine than toyotas,I am mow left with one option to surrender the car back to toyota whom will purchase the car for less than the outstanding amount which is £3663. and i will have to pay £170 towards clearing the outstanding balance. I m upset how unsympathetic toyota financial services have been towards me and my family , i have tried to continue payments to toyota but they are refusing it ,there is no payment protection as it was too expensive i would not have been able to afford the payments . I just cant believe why they wont accept payments until balance is paid off , and i have my doubts about credit agreement legality if you need a driving licence how they did this agreement in the first place as my mother never held a driving licence i drove her about due to her being disabled . please help me desperate not to loose my £10k i ve paid in to the car , but if i have to give it back i may not have a choice xxx thanks for listening x

    Get the agreement from you dad and have a good read, see what the situation is and what type of loan it is.
    I think it is HP which means they can't take it back.
