    Default Aaaagh now what...PPI frustration...

I have just joined this website, it is fantastic.

I am really hoping someone can point me in the right direction with my PPIicon reclaim. I recently submitted a PPI reclaim for approx £11k to Loans.co.uk. I followed the guide on the money saving expert website and after getting nowhere with Loans.co.uk, I complained to the fosicon. They have told me they cannot do anything because Loans.co.uk, were not regulated by the FSA at the time my PPI was miss sold. The FOS told me to contact the Finance and Leasing Association. I have never heard of these people and I am not sure if they can help me. Does anyone know If they can help me or should I consider legal action against Loans.co.uk and if so, how do I do it?

Please please help.....my fingers are crossed...

    hi

i am assuming the reason the fosicon will not take on your case is due to the loan being taken out pre 2004. Is this the case.

I was in the same boat so i am taking the court route alone. Let me no if this is the case and give you guidance.

Thank you very much for your reply. You are right, this is the case. It was actually sold to me in 2002. Just over 6 yearsicon ago, although the account was active until 2004 when I sold my house and paid the loan (and PPIicon) off.

    Hello CMD

Yes, I also think it is disgusting that any unlawful activity by companies prior to the appointment of the FSA in 2004, is left to the poor customer to deal with, the have no recourse with the enforcement authorities, their only option is court. And of course these despicable companies know this

I do believe you should sent a complaint to anyone who will listen or not as the case may be

Here is a link to the FLA code of conduct for whoever was registered under them and this is what they should have done

If you scroll down on the link there is info on the 2002 coc

This is a standard fob off they have given you, and I am sure that you are aware the loan.co were heavily fined by the fsa

    http://www.fsa.gov.uk/pubs/final/loanscouk.pdf

So keep at them and do not take their pathetic response for an answer

YOU HAVE NO CHOICE BUT TO GO VIA THE COURTS. THE HARDEST PART IS GETTING YOUR POCicon (PARTICULARS OF CLAIM) CORRECT. YOU NEED TO GET AN N1 FORM FROM THE COURTS. YOU CAN GET THIS ON THE COUNTY COURTS WEB SITE.www.hmcourts-service.gov.uk

COMPLETE THE FORM AND SEND WITH COURT FEE. IF YOU NEED HELP WITH THE POC GIVE ME A SHOUT. LOOK AT MY THREADS FOR HELP AND GUIDANCE IF YOU INTEND TO GO DOWN THE COURT ROUTE.

I TRIED WITH FSA ETC AND ITS A WASTE OF TIME DUE TO THE PRE 2004

    Hello Clearmydebt

You are more than welcome, my advice now to you would be please take you time and ensure that your POCicon is water tight

Please read around the threads, there is a wealth of information in them.

Also be mindful, if this loan was taken out via a broker, there may have been disclosed commission paid by the lender to the broker,

Also there is a very important and interesting thread regarding Multiple agreements.

Sometimes you have to look at the bigger picture, when you are embarking on reclaiming back you PPIicon, you must be prepared to hit them from every angle

    read this thread

Multiple agreements falling within section 18 CCA 1974

    and this one

    secret commisions
