i have had a mortgage with them for about 3 years now and the charges they are putting onto the account are just silly. i.e. £25 for non payment for DD, Late fee £50 and so on. so just wanted some help and advice if possible thanks.

Yes you can begin a claim for all charges that are similar to the bank penalty charges.
You need to follow the same process submit a SAR get all the information and then start sending in the letters requesting the unlawful charges are refunded.

If you haven't already got your statements to make you list of charges you'd like a refund for - do as suggested above and send a Subject access request - ask for "everything they hold on this mortgage account" you'll get everything you need to enable you to make your list asking for your refund.
Once you've got that information together - use the spread sheet here in CAG to write up you schedule of charges that you'll be asking for a refund - the spread sheet will automatically tot up the 8% interest you can ask for too.
Adapt the Preliminary Request for repayment letter - it gives the company 14 days to refund your money. (letters are all in the template library here for you to edit to suit your needs)
Then send the letter before action letter - this gives a further 14 days to the company.
The company will probably tell you "no - it's just bank charges - it's in the mortgage papers about the charges for a mortgage" - or words to that effect.
Copy all these letters and the companies reply/refusal to repay your money with the schedule of charges to the fos (Financial Ombudsman Services) there is a link to the complaint form in the A-Z list here in CAG.
FOS will investigate it for you and chase the company for your charges refund etc.. there is no ned to go the court route etc.. unless that's the route you'd prefer to take. Most companies will sort the problem out rather than have FOS investigate them for what they are doing.
