Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have just recieved notice of a default sum of £30. Shocked and disgusted I rang them up to find apparently because I changed the registration on my car I purchased with their car finance with my pychic powers I should have known to pay them £30!!! The best thing is they state that apparently clause 10.2 of my aggreement 'clearly' states this. Read this...its hilarious!....
"We may at any time assign, charge or otherwise deal with our interest in this agreement but you may not do so"
Well thats very clear isnt it!
Can anyone help with this? I think that the clause is very ambiguous and is not specific enough to refer to a reg transfer. So I have refused to pay the £30 at this point. Do they have any leg to stand on??? Hope someone can help x
Just my thoughts. The vehicle has not changed in any material way and the number plates are an additional item that do not change the construction. You are paying for the vehicle designated by its VIN etc. Their interest is in the vehicle and that clause merely states what they can do with the agreement (ie they can assign the agreement to a third party or they can use it as security for their own debt) what 'otherwise deal with' means is beyond me. I'd be tempted to tell them to go away in short, jerky movements.
I had the same thing. Its something to do with HPI checks on the registration. I swapped my number plate without informing my Finance Co. I then VT'd the car, and a couple of months later they sent me an invoice for £25.00 but quoting the original reg! Idoits, needless to say I didn't pay them as they couldn't prove it!
Well after several emails they have finally waived the charge. The last person that emailed me said that that was not the clause that confirmed they could charge for an admin fee however funnily enough didnt come back with exactly where it states they can charge for changing the reg. I was gonna email again but thought I wont push my luck lol x
