I first applied to have bank charges returned to me early last year and was sent a Breakdown of my statements etc. I sent the 2nd letter but was replied to with a letter telling me that due to the test case no payments would be made.
My question is whether it is now possible to actually claim back these charges in Scotland? I have looked on the site but I am unsure of whether I should restart the process. I have racked up loads more charges since then and I would estimate I would be making a claim for at least around £4000.
Please let me know if I should get this moving again or if the situation is currently that there is nothing I can do.

It is highly likely that your claim will be sisted (put on hold) when you file at court but filing a claim stops the clock as far as the limitation period is concerned. So even though it probably will be sisted you should still file a claim.
Alot of Sheriffs are still going ahead with cases in Scotland. It would depend on the court and which Sheriff hears the case.
