Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
On 3rd Dec I bought a Samsung Home Cinema kit, purchased that particular model solely because it had a free wireless adapter for teh rear speakers included as an offer.
On purchase the Saleman informed me that teh adaptor was out of stock but would be placed on back order and i would get it wihin a few days,
Several store visits later i was informed a week ago that they would be instock on 16th Jan, so today phoned the store only to be told, they are now due on 1st Feb
That to me is not acceptable, How can a salesman claim an offer is available when teh store doea not have the stock to fulfil teh offer.
I have asked for a refund, but was told as i have used teh system that i snot possible as it is not faulty,
Surely I am entitled as i have been misold the Item

Well as a salesman for the same company I can sympathise with both you and the salesman. To be blunt, the stock ordering system is nothing but a guessing game. It basicly says a date the company is "expecting" the items in stock and either allows or doesn't allow us to order based on this information. Unfortunately for us this "expected date" is rarely correct, and if an item is discontinued by the manufactorer without warning before we recieve stock to fulfill orders, we're basicly screwed, and have an angry customer to deal with.
Was the wireless kit sold separately or in a package, if alone you can get a full refund for the wireless kit. If in a package, because you've opened the theater kit, you'd be entitled to a refund of the value of the wireless kit in the package (at it's package reduced price). Check your reciept to see if the wireless kit, and theater kit have different individual prices on.
As for refunding the home theater kit. You were under no obligation to open the kit and use it until you had the complete package, and from what you've said, if the wireless kit was so crucial, you'd surely have had no reason to open it until you had one. If you stated you needed wireless speakers to the salesman and he ordered and sold you a kit with a wireless adapter, then the package has not been "mis-sold"* they have mearly not recieved your stock.
You could ask if they can get the stock from another branch, or have it couriered to your address from another store.
I don't know how this would work out legaly, so I'll leave that area to someone else.
*May I just add, for the record. Mis-sold is a term implying that an item was described to be something that it is not, or to do something that it does not in order to get you to buy it. If I sold you a DVD player telling you it will play Blu-Ray disks, then this is an example of mis-selling something. Currys imply harsh disiplinary measures to sales-staff who are even suspected to be mis-selling stock, so please be careful with your terms as it could cost someone their job in this difficult financial climate.
My reciept says SAM HTZ310R+SWA4000 then the price for teh 2 items
Basically it was by the cinema kit and teh wirless kit came free.
So whilst they were able to supply the cinema kit, they could not supply the wireless adaptor (its a seperate pack) but is included in teh price.
The store i used has rung all the local stores, including teh pc world ones but no stock anywhere.
Why wouldnt i open teh cinema kit and use it, using the wires as a temporary measure as i have, the wireless kit was more for teh conveniance than anyhing else.
The problem is I would not have bought that model if it was not for teh offer, Currys are having trouble fulfilling the offer.
