I took out a loan with Tesco PF in may 2003 and have been trying to claim back my PPI. Today I received aletter stating I signed the agreement so tough. There is no box on the agreement which gives me the option to tick for ppi or not. I am now putting this to the Ombudsman could anyone give me some advice

Yes tough it may be if they have not followed the rules on selling and advising you of the cover you could expect and all of the small print exclusions that would no doubt appear in the terms and conditions of the Consumer Credit Agreement. There is no box on the agreement which gives me the option to tick for ppi or not. I am now putting this to the ombudsman could anyone give me some advice WELL DONE Go for the fos option and also keep the FSA, OFT, Trading Standards and the rest of the known universe informed.

The case workers will gather all the relevant information from both sides Tesco and you. The information will then be passed to an adjudicator. You should get letters from the fos at each stage and they will make a decision on whether your complaint will be upheld or not. If you are not happy you can request that your case to be looked at by the Ombudsman but this will take some time.

fos have advised it could be 6 to 9 months but it really depends upon the complexities of your complaint.
My complaints on PPI were submitted in August 08 and settled in Dec 08.
If you do not accept the decision of the adjudicator and ask for the Ombudsman to become involved it will extend the timescale.
I cannot be more specific on the timings.
You will probably get the usual goodwill gesture without admission of any liability, but this is mainly to keep the FSA off their backs. If the FOS uphold your complaint or the goodwill gesture comes in you should get the premiums paid plus the interest on the premiums and 8% statutory interest to the date you accept any offer.

Question here is your claim against Tesco PF and RBS or is Tesco PF arranged thought RBS?
Also not PPI related but why have I got " you have new private messages" flahing in red and how do I retreived them I do not know why you have new private message (PM) but if you want to access PM you just click on the private message link which is underscored like any link and you should be able to read and reply.
If your claim is against RBS then the Manchester office is the one that will deal with it and that is the office the FOS deal with on PPI reclaim cases.

Just to let you all know I received a letter from the fos saying that Tesco are making me an offer of goodwill for the full PPI +8%. (Please make sure the refund of your money includes the premiums and the interest added to the PPI premiums and then 8% statutory interest on top)
They will try and short change you if they can down to the wire they want to keep your money obtained by alleged deception methods
So for all you out there do not give up.
These companies like the goodwill offers without any admission of liability, just like the bank charges goodwill offers. This makes them feel good and hopefully gets them off the hook as far as fines go from the FSA (who are also under attack now for failing the financial industry by being toothless so it would seem allegedly.)
