Default barclaycard ,ignoring my depression help! please

I am been in a debt repayment planicon with several creditors, ifirst through trading standards then payplan, I have been off work ,with severe depression now for eight months and am currently on incapacity benefit, I am only paying the token payment of a pounfd ,not in a position to do anything else.
for months they have been hounding harassing me from about 8 till 830 9 ish nearly everyday. payplan wont help about complaining , found this site and have sent harassment letter, doesnt seem to have made a difference,

How do I take that further?{ I'm in scotland} if they carry on , can I actually take them to court? could I try for compensation ? they really are affecting my health. sorry but this site is big I need direction.

    thanks

    from another thread

This form is well hidden on the OFT's website and appears to be for the use of solicitors, but I see no reason why individuals cant use to to bring DCA harassment to the attention of the authorities.

    oft debt collection complaint form

Click on this link and you will get a PDF complaint form from the OFT.

Print it off, complete it and send it to:

    Enquiries Centre
    Office of Fair Trading
    FREEPOST
    London
    EC4B 4AH

The more people who do this, the more chance we have of something being done about illegal DCA harassment.

Default me against barclaycard -court action?

hello , I have been suffering with BC for months now , they have been hounding me , I have started fighting back , sent harassment letter, which hasnt worked, I am at home with severe depression and they are aware that their actions are affecting my health.

Ihave said in my letter to them that if they keep harassing me I will take them to court and seek to have my debt reoved and claim compensation for the stress and anguish they are causing my health.

my problem is , how on earth do I go about that?{court action, im in Scotland}, and how could I work out an ammount to try to claim for compensation? thanks for any advice

    Hi Taff,

Have you sent BC a CCA request for the relevant Credit Agreement.

You can either use Letter N from here - http://www.consumeractiongroup.co.uk...templates.html

Or read this for a more recent strategy - http://www.consumeractiongroup.co.uk...uldnt-use.html

Also, have you set about reclaiming penalty charges on your a/c's as a way of reducing the debt owed on each a/c.

BC are repaying charges quite readily at the moment.
