    Default NCP penalty charge - urgent advise needed please

    So basically last week received a £50 parking charge notice (£100 if later than 28 days) in an NCP car park for apparantly causing obstruction to other vehicles while parked to which i dont agree with.

    Anyway, its come to my attention today that they've taken down my number plate incorrectly by mixing up a letter on the plate. What would you recommend i do considering this circumstance?

    I was thinking of phoning them, pretending i lost the ticket and then asking them if there are any charges associated to my plate (to which there wouldnt be as they took it down incorrectly). I could then take down the individuals name of whom i spoke to for reference. Then if NCP eventually manage to find my details and start interigating me as to why i havent paid the ticket i can use the call as proof of having called up and being told there was no outstanding charges.

    Or worst comes to worst i was thinking i could call them up, get the number plate corrected and then have a go at them for the mistake they made. I could ask them to compensate me/reduce the fine as i had to pull a sick from work and travel to a friends house just to make the call and get it corrected as i dont have a landline and also complain about the cost the call is costing me.

    What would you say is the best thing for me to do?

    The only way they can trace you at all is via the DVLA using your reg number. If that is wrong they won't be able to get your details. So it's unlikely you will hear from them at all.

    Ive read this quite a bit on the forum, but how much success have people had by following this rule with NCP? I would be worried about bailiffsicon being sent over or being taken to court, the fine could end up racking up a lot more.

    Yeah thats what i was thinking, only problem is i dont know if the attendant took a picture or not, if he did they could always refer back to that to realise the mistake they made.

    They cannot send bailiffsicon. First they would have to take you to Court (they won't) then they would have to win the case. Then you would have to fail to pay, and then there is a possibility of bailifficon action. It just won't happen.
    Many people here ignore PPCs with much success.

    Ive read this quite a bit on the forum, but how much success have people had by following this rule with NCP? I would be worried about bailiffsicon being sent over or being taken to court, the fine could end up racking up a lot more.
    • NCP - don't do court and give up after 3 or 4 letters.
    • Their paperwork is downright fraudulent so they won't go anywhere near a courtroom.
    • There is no 'fine'.
    bailiffsicon only apply *if* they take you to court *and* you lose *and* you still refuse to pay.

    any pcnicon which is incorrect for any reason will become a PA error. if your VRM is wrong go to the local parking shop and chances are they may cancell there and then or appeal against the PCN. the penalty is void if there has been any mistake made

    This is a PPC invoice not a council PCN, any so called appeal procedure is a sham, they just want your money. As the previous advice given (and on Penalty Charges ), ignore it.

    This is an unforceable invoice, not a Penalty Charge Notice (PCN).

    There is no appeals procedure for this.

    Unreal, the thing you have to always bear in mind is that companies like NCP are brilliant at making their paperwork look and read as official, to fool people like yourself that any attempt to resist is futile. The threat of debt collectorsicon to uninformed people results in many to rush to their cheque books to make the problem go away. These companies rely on your ignorance and fear to generate their revenue. When you get to learn of their tactics and see through their empty threats and recognise their methods you will realise you have nothing to fear. I can assure you that you would be best advised to not contact them at all and ignore any correspondence you may receive.

    My understanding is that clamping (if legal at all) can only be carried out regarding a current trespass. i.e. you would have to be doing something contrary to their terms at the time you parked to get clamped, and then only if they clearly display signs saying you will be clamped for such a breach of their terms.

    Clamping for a previous unpaid invoice would most definately be illegal and I presume therefore your remedy in response to this should be a bolt cutter.

    The reason i ask this is because i still need to use that car park for the next 7 months, ive no alternative. Considering they dont have my correct plate at the moment (mixed up one letter) whats are the chances of them finding the correct one assuming they havent taken a picture of the vehicle? And if they were to find my correct plate eventually and i were to ignore the letters, i should still be able to use the car park without them doing anything to the car?

    Bang on Crem.

    There are legal requirements for clamping by private contractors. The clamping guide in the stickies gives details (as does the SIA website.)

    You would also have a case for seeking damages as they have comitted trespass against your property.

    There would also be possible criminal charges arising - interfering with a motor vehicle.
