Hello to all on this thread! I am feeling a bit like a thread tart as I have been on debt collection Agencies, the kind folks on there helped me control the DCA's, Barclaycard- the wonderful chaps on there helped me to reclaim charges and pointed me in your direction for help with PPI!
I have already received SAR from Barclaycard that shows monthly payment protection and also intermitantly something called Barclaycard Card protection that ranges from £16 to £35.
Before Xmas I requested my CCA but to date have received nothing. The card was taken out in August 2004 and is still being paid. They have reduced balance by the reclaimed charges and reduced credit limit by half, not a real problem as I just want rid!
Do I now persue CCA? I don't think I need to put the account in dispute do I? Also should I now request that they cancel my PPI payments?
I am a total PPI virgin so any help will be appreciated.

Do I now persue CCA? If you have paid the fee and they fail to respond within 14 days from the time they get your letter you can put the account into dispute or alternatively lodge a very serious complaint with the Information Commissioners Office pointing out the failure of Barclays to abide by legal statutes of the land namely the CCA 1974. I don't think I need to put the account in dispute do I? Also should I now request that they cancel my PPI payments? The advice I received from the fos was to cancel any existing PPI if I had not already done so. This was after my bank had offered to settle. Cancellation of PPI will result in a refund which will be taken into account when they refund you payments with the interest added plus 8% statutory interest from when the loan started to the date of your acceptance.

Read a few more threads to gather information. My fight has taken over 12 months and still ongoing on the last of three complaints check out my thread and use anything in there cobbled to your own needs to assist you.

I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner. ------------------------------------------------
Bank charge successes:
Halifax - Full settlement incl interest.
HSBC - Settlement, goodwill no admission of liability about 75% of claim.
RBS - Settlement, goodwill no admission of liability about 70% of claim.
2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
PPI Successes
PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
2 claims settled in full with LV without FOS involvement.
2 claims settled in full with HSBC without FOS involvement
PPI Claims ongoing with:
Cap one Now with the FOS
Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc
Please do not PM me for advice as it may be sometime before I can respond.
Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

By the way I am not sure if they will be able to find the agreement , if I remember rightly we applied on one of those magazine inserts they used to do! Don't think they can do that now!!

This give you the opportunity to submit a Very Serious Complaint to the Information Commissioners Office as they have failed to comply with a legal request for information under the Consumer Credit Act 1974.I do want to keep up with the payments can I still do that if I put the account in dispute? If you intend to carry on paying then there is no need to put the account into dispute. If you are also considering cancelling the PPI then again why cease the payments as this will automatically happen when you cancel. However when you notify them that you wish to cancel it is adviseable to send your letter at least recorded if not special next day delivery and insist on a written acknowledgement.

They are messing you around as most banks and organisations facing PPI reclaiming do. They try and make life difficult do the same back to them.
Every complaint to the Financial Ombudsman Service for example on poor customer assistance etc will cost them £450.00
I have had three with the fos the more complaints the merrier and the sooner they will get the message to settle. It is the Ombudsman that get the work but they are pretty good.
