I’m new to this forum and hello to you all.
Monday evening I parked in a car park beside a restaurant about 7.45pm, (didsbury, Manchester) I never realised it was a pay and display car park (even though there was some signs I noticed afterwards) now after 8pm parking is free but when I returned after eating in the bar at 9 pm I had a parking ticket from a private firm demanding £50 if paid within 24 hours then £90 within a week and £ 120 after 28 days.
Also the parking meter was not very easy to spot in the corner.
It seems like for 15 mins before the parking would have been free then this fine is far to high (it costs £1 for an hour) also the car park was virtually empty.
Do you think I should pay this fine or just ignore it ? it is a private firm, I don’t have their name to hand.
Any advice appreciated.
please post the ticket (both sides) after removing registration number.
Prima Facie I would say
1 dont contact them
2 dont enter into any correspondence with them
3 dont pay them
4 they will eventually go away
but we need to see the ticket to be sure.

Hi,
The ticket is a long slip (like till receipt) The Company is called SIP (Stop Illegal Parking) PO BOX 495 Manchester M14 )FE.
It states the reason: No ticket displayed. It has my correct Reg No and make, model and a pcn number. Date and time correct.
It reads:
If paid within 7 days charge of £70, If within 24 hours £50 7 days £70, upto 28 days £90 and after 28 days £ 117.
It has an 0845 phone number but says for payment only, no conversation in relation to penalty( no other phone number provided)
Failure to pay parking charge within 7 days will result in details being obtained from DVLA and payment will be £90. After 28 days £117 and details forwarded to our Debt recovery agency for Collection. This will incur further admin and legal fees that you will be liable to pay.
Also mpayment can be made by post to above PO box address.
Appeals: if you wish to challenge, write to above PO Box address.
So that is all the details on the slip, could you please advise what i should do next? ignore or conatct them?
My advice remains the same but we could really do with seeing the ticket.

Hi, Do you mean you need to see a photo of the ticket? i have quoted above all the info on it, its basically a printed till type ticket, on 1 side only.
This is not a fine - this "penalty" is a contract under which you allegedly agree to pay the fee, with the terms and condititions posted on a sign in the car park and you agreeing to them by parking.
However there are so many ways in which these are unenforceable they just hope that they can intimidate you into paying.

There was someone else on another forum dealing with these jokers. Hilarious name and I would be interested if even calling your company that would be fraud of some kind.
• do not pay
• do not contact them
• they will go away after 3 or 4 threatening letters
The name of the company should give you some indication that this is a [problem].

I will not contact them and see what happens, but they have to prove i was the driver and also the penalty is totally disproportionate for 15 mins parking. I'm sure that many people would just be scared and just pay up thinking they had committed a serious offense.

they will write some rubbish letters then after a while it will go quiet. they called it a penalty, they are stuffed (just one reason among many). file anything in the drawer and carry on carrying on with the daily grind.
When parking in a private car park, the contract is between the person driving the car and the private company, which means that only the driver can be subject to the ticket.
Correct me if I'm wrong here, but as far as I can see, if they don't know who the driver was, they really cant claim the penalty. Even though you own the car I dont believe that you are under any obligation to tell them who was driving the car either.

When parking in a private car park, the contract is between the person driving the car and the private company, which means that only the driver can be subject to the ticket.
Yep. Even assuming a contract was even formed and whether the terms were fair.
