    Default Bus Lane Ticket - Issued 5 Months After Offence

    Hi
    Having looked around the forum and the internet in general, am I right in assuming that Bus Lane 'Tickets' have to be issued within 28 days of the Offence taking place?

    Partner has just received a fine [issued 6th Jan] for an offence that she committed in August. The notice arrived with an image of her stopping in bus lane from a cctv camera.

    Any help appreciated.

    As far as I am aware (and I stand to be corrected on this)

    Unless the car is a company or lease car (thus not registered to your wife at your home address) then the NIP (notice of intended prosecution) needs to be served on you within 14 days of the offence.

    However if it is a lease/rental/company car then the time limit can be upto 6 months (I think)

    Is this the first that she has heard regarding this offence or has there been previous correspondence?

    Flydoc, you have the right idea for a criminal offence being pursued by the Police.

    The 14 day limit is for the first NIP following an alleged offence to be served on the registered keeper. Subsequent Nips are not time limited, but information must be laid for the issue of a summons within 6 months of the alleged offence. For a compnay or lease car, the requirement does not alter, but the driver is highly unlikely to be the RK.

    If for some good reason, the DVLA do not have valid details (newly acquired car, new address) then the Police can show that the 14 days was impossible to meet and the court will accept this.

    For a pcnicon, the authority has 28 days from date of contravention to serve a Section 10 PCN (unless S.10(5) applies - which is where the DVLA cannot provide valid data - in which case the limit is 6 months)
