Hi guys after reading into this forum and having probs of my own, i decided to ask for your thoughts and advice,
Recently tried to get a loan to clear my feet, and only Welcome (sorry yes loans) could help!
Story goes like this:-
Made loan app to my bank and was refused, but they did offer to put me onto companys who may help,
phone call from "yes loans" approved for £5000, providing i can provide my proof of income ect,
During call they ask if i have ever been a customer of welcome finance (i had ) so i was told sorry we cant help, phone this number welcome will deal direct,
Aproved for initial loan of £5k then they start selling PPI, i said" no not really intrested" but was assured it was best and i could cancel later if i want, so agreed (felt i had to or loan wouldnt be there) then they went thru my finances and said i could get £3800 based on my outgoing, as i can afford repayments of 188 a month,
Great i thought then recieved 2600 in bank the rest was my insurances, My fault for not reading docs b4 signing,, i have shopped around and can get insurances alot cheaper and better, when my policy came thru i will not be able to claim unless i loose a limb !!!
Luckily im still in cooling of period, altho i have made my first repayment i have wrote and phoned to cancel,
I got a reply confirming my cancelation if i return the enclosed new agreement (higher apr and now only for £2600 )
I wish to keep original amount and use the excess money to buy other insurances, they will only allow me to sign new agreement or keep my ppi ????
Now my question is,
can they do this ? or can i ask for the rest to be forwarded to my account ?
you did the right thing to cancel the PPI in time
the letter from them saying ppi in force till new agreement is signed is bovine excrament
as you cancelled the ppi, they have to send you out a new agreement minus the ppi element.
the first agreement is legally binding, sign a new one, that cancells out the first.
you did the right thing comming onto the forum before welcome conned you.
this is how it should go
you signed an agreement with ppi
you cancel the ppi with in 28 days, cooling off period
welcome send a new/modified agreement for you to sign minus the ppi element
the new agreement has to be the original ammount loaned and at the same apr
they just cant change the agreement when they like
original agreement total credit £3867.72 apr 49.92%
new agreement total credit £2700 apr 50.92%
both acceptance fee of £75 added to charge for credit
is this all making sense ?
thats what i was hoping to hear the cust services want me to sign the new agreement and go into local office to apply for a top up to bring me back to the £3867.72????
ime not surprised they want you to go into there office
sign it on trade prem, you cant cancel any insurance product or agreement
no cooling off period
demand the difference from two and a half grand and the ammount on the agreement three thousend eight hundread
they cant just change the agreement to suit them selves
no top up
just demand the original ammount on the agreement
if they refuse, tell them you will put in a complaint to the fos, that will cost them 400 quid

as you realise, they are con merchents and you prob regret ever dealing with them
i had dealings with them about seven years ago difrence was it was a car finance and after a lot of hassle they bowed down and accepted my complaint cleared my outstanding and the gent was true to his word as the comp says my old case was completed satasfactory lol i think parking car outside offices with placards detailing service and probs was disrupting there buisness lol regarding new problem i am still paying full amount per month so my ed of deal is being kept if i have to go to fos????
p.s.
they tried everything to get that car moved but it was legaly parked never actually used there name altho reg plates had there name on it even tried injunction at court, the court rejected it lol,
i like to dig deep into theese things and i am a stuborn person !!!!

only reason i ended up there again was for my kids xmas sake
employers went into administration and payments were not gaurunteed on time (all ok now tho)
