Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Ive just posted my SAR to Barclays bank using one of the address on this forum so fingers crossed I should get some statements back. Ive been with Barclays quite some time and know that in my younger days I was a bit (??) reckless so here goes nothing.
I'm now tring to do the same with 4 other institutions so its gonna be a costly business if I have to file a claim for all but I suppose it'll be worth it if I get my money back!
Anyway, Ill keep you updated
Thank you very much..... I sent one off 2 week ago, 1 off a week ago, and 3 off today so hopefully they wont all need paying for at exactly the same time!!
Ive asked for statements from Cap 1 aswell but theyve said they'll send them free of charge which I was surprised at!!
Thans again for the good luck wishes!!
I've got a number of claims I'm going to pursue as well. I was advised on my thread to maybe just submit one at a time as then you'll have the money back from one claim to help pay for another.
I was initially quite keen to get them all in as soon as possible as it seems just too good to be true but realistically, I think it's probably easier to get one done and ask all your questions and the other ones should be straightforward.
I've been waiting 11 days for statements from Barclays, they've charged me £5.
Did you just telephone Capital One?
yeah i just rang Capital One just to see if they'd send them to me and they said cause I wanted them to check my debt management planners were making the required payments they'd send them for free! And I phoned again today to check it was being done and the guy said he could see that they'd been ordered!
Thaks for the advice though. I think my main concern is that soon they will find some loophole in the law or some judge will say 'right only claims that are already in the process can proceed' etc etc.
Basically Im a bit scared cause Ive waited til now to do it and I reckon between me and my husband we should be owed a few thousand and I really dont want to miss the opportunity to get it back. These people have made our early married days hell by adding charges onto a debt we already told them we couldnt manage and now I want it back!!
Thanks so much for the advice though....Much appreciated....I'm too impatient!
Please be aware that the Bank is not under an obligation to present information according to any particular format. Therefore your request to assemble a schedule of charges is turned aside. You may of course obtain this data from copy statements and these will be supplied to you within the next few weeks without charge on this occasion. As the Bank is providing the copy statements on a complimentary basis your payment is returned herewith'
So.....is this a sly way of not having to comply with the 40 day rule?
They were very quick to respond as I only sent my letter on the 19th
Received a call from a lady who works with Peter Townsend (who my letter was signed by) saying there is a backlog of these requests because so many people are requesting statements at the moment but if i dont here anything by 20th August to call her back. Thought this was nice of them and 20th August is less than 40 days. So, they sent back my payments and are saying that they will send all my statements within 40 days.......Too good to be true?? We shall see.....
I got mine today after 15 working days. I'm not too sympathetic when they talk about a backlog because I am fairly certain that ordering the statements is an automated process just like bank charges - and there never seems to be a delay when they are charging you £20 plus is there?
My SAR was sent to :
Centre Manager Barclays Bank PLC
Customer Services
Personal Banking
Leicester
LE87 2BB
What I got back was the most horrendous printout ever!!! It is legible....just, and you can see what the charges are but its not a simple as some of the other where u just get your statements.
Also, my account has been open approx 5 yrs so thats what I got. Obviously you request the full 6 yrs if your account has been open that long if not just request for however long it has been open.
It took around 28 days but from what they told me in my letter is that they have a huge backlog now....Probably more people finding this site!! lol
Hope this help??
based on this i have requested statements direct from Barclays by phone. they are sending statements for the past 6 years which include all my time at university so should make scary reading.
My claim is for just over 500 pounds and I sent my pre-lim to receive a letter saying 'thank you for bringing this complaint to our attention we will investigate and get back to you by 22 september'
Ok now I know this is pretty standard but I sent my lba two weeks after my pre-lim only to receive the exact same letter!!! Is this right???
Also can anyone tell me how likely it is that a claim as small as mine will be paid out or is gonna be necessary to do MCOL??
You will probably get an offer within the next week - from what you are claiming, probably in the region of £325. It's up to you if accept or reject. I also received a letter from them which appeared to be out of sync. I just ignored their timescales.
Your lba 14 day deadline expires on the 19th of September. If you decide to go the court direction, file on the 20th.
Thanks for the advice, it would be pointless if I accept less than Im owed as the o/d on the account is 500 so im hoping to clear that. However, if I did receive a decent offer I may settle simply because I have others going on with other banks for a lot more money than this!
I think this is pretty standard as I've had something similar. They must be getting inundated with claims now and are probably just generating standard response letters!! (Wonder if these letters cost £30 to produce?!!)
I'd see what other users advise but from reading other threads, I think the best thing is to stick to your timetable. You've sent them letters telling them what you are going to do and when, you don't need to do any more.
Regards to the amount, I think again you might need to go to MCOL as my view is Barclays are paying out but they are trying to save money wherever possible by offering smaller settlements and hoping people will accept this and also be put off by the thought of going to court. I think you'd need to go to MCOL as this shows you are serious about retrieving 100% of your money.
I am sure they will pay up in the end; they will just try and make it difficult in the hope that you'll give up - I'm sure you won't!! Good luck!
