I am querying this for a friend who was informed that as he had not informed the DSS that his youngest child had since left school he had been overpaid by £600.00 over a year circa 1997. Nothing has been heard since this time until recently, when once again they are trying to reclaim this amount. Legally is he still liable to repay this after 11 years. cheers Dave
Yes, he is liable for as long as the debt is owed. However, the overpayment would have been classified as ownership of the overpayment has to be established.
What that means is basically who's fault the overpyament was. In some cases if it was an official error it can be written off.
Only your friend knows whether that is a possible "out".
Otherwise he is liable. Depending on his circumstances he can pay back a small amount a month. As long as he's repaying, the DWP won't be too bothered at what rate.
This came about as he was unemployed at the time, his youngest son left school, and they claim he should have made them aware of this. I guess it depends on whether he should have, whether they should have been informed by another department or not.D
