Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I'm being visited on the 20th for a random check of housing/council tax benefit claimants which the letter saya will replace my annual review form.
I'm fine with this. I live alone with my 4 year old son and claimed housing benefit since May this year. They say they need to see tax credit statements and tenancy agreement and evidence of maintenance recieved by my son's father, which is fine.
I'm worried because my boyfriend was made bankrupt last month and so he had no bank account to be paid into till it went through the official recievers and all that so his employer paid it into mine. I'm worried that this will be a problem as they want to see my last 2 months bank statements.
It was a one off for about 800 pound and i took it out for him very soon after.
Do I need to worry? and should I do anything else to help resolve it?
Welcome to the site.
The rules are that you should report any changes in circumstances-that includes any money coming in.
Obviously you will have to explain the £800 which appears on your bank statement.
All you can do is tell the truth-but its your choice and only you can decide.
If you fail to satisfy them that there i good reasons for this, then you can be sure of ongoing investigations and the possibility of prosecution for failing to disclose.
I will move your thread into the benefits forums.

Hi,
As long as you've got documentary evidence that the money wasn't yours (i.e. for doing some work you hadn't told the council about), then you should be fine. If the payment was through the Official Receivers, then your boyfriend should have all the necessary paperwork.
As the money wasn't actually yours it shouldn't be classified as a change in your circumstances; your bank account was just being used as a cashing facility. I assume from what you've said that your boyfriend doesn't live with you? If he did, then that would be classified as a change, but as he doesn't, it should be OK.
Thanks for that. he doesn't live with me, no. He has pooof of address and bills ect too.
It was a bacs payment in his name with id number ect so will that satisfy them? It was a one off till he can get a basic bank account again.
The first reply I got was a bit scary! I dob't see why I'd have to delare it as a change of circumstance since it isn't really. And it was only the 19th december it went in.
I'm confused by what the first reply meant by "it's my decision" too.
Pramface-the reply wasnt meant to scare, merely to point out that as far as they are concerned, its money that you didnt tell them about.Their rules are very open ended and that was my point, even though I know what you said.
They will have come across this before in all likelyhood,I am just trying to help you to look at it in their eyes.
My reference to it being your choice was meaning how much you choose to tell them about your relationship.
Its really of no consequence,if there is, or was no financial gain that would affect any entitlements.
If they are looking to find any irregularities, then the onus is on them to find proof, rather than for you to prove innocence.
Hope thats a little clearer.

Yeah, you're probably right. I just hate any kind of untruths or bending the truth. I shouldn't have to really cos I've done nothing wrong but i can see why i probably should.
Thanks to everyone for all the posts. It's very reassuring.
The rules have changed within the last month regarding capital. If you have capital of less that £6000 this is not counted at all (no change there then) but proof does not have to be provided with new instructions from the department of works and pensions. Sounds like an odd instruction to me as it can look fishy if you say 'but I don't have to show you my statements'.
I would go along with the advise offered above but you can see that it won't have any effect on your claim. Are you on Income support as the benefit officer may not even ask to see bank statements, proof of your residency can be satisfied by a tenancy agreement, benefit letter, medical card, utility bill etc. This is really just a routine visit and when it is over you will wonder why you were worried - I see this all the time as I am a benefit officer for the council. All the best
