    Default really worried please help

    hi, i have had a letter from the benifit office asking me to attend a customer compliance interview. ill try and explain in the best way i can. i have been living with my bf for about 5yrs , in that time he has not claimed any benifit nor i have claimed for him. he has never worked in the time he has been with me.i am on income support and i have 3 children.the youngest two are his. i have never told the benifits agency hes been living with me nor have i told them he dad of the younger two. i knew this was wrong but i did not do this to gain any money watsoever. i did this because my eldest child has a severe disability and when i became pregnant with my bfs child i could not cope . i wanted to be above board with everything,i telephoned the law society and asked if i had a boyfreind come and live with me could he become a joint carer for my eldest son, they said no, that the benifit agency would make him go to work.this is the reason ive been living a lie . no money gains at all. i just cannot cope on my own . when my last child was born i did not claim cb for him for over a year as was to scared they would start asking questions. if anything ive been strugling to keep all of us on my money. if i come clean what can they do to me?im really worried and just want it off my shoulders instead of trying to get out of it another way.please help

    I would just say that he stays overr some nights and stays with friends the rest of the time he doesnt claim anything and does not pay you anything they may stop you money but its best to come clean then you can everything above board

    Welcome to the site.
    You are not the first and wont be the last,theres lots of others who have come here with the same fears.
    Whilst admittedly its wrong to defraud or cheat the system,there can be many reasons why it happens and in many cases there are circumstances and personal reasons that make things more difficult to deal with-for example there have been cases where women have been genuinly worried or frightened to come clean,because of the possible repurcussions from violent or bad partners.
    Some guys threaten the women by saying they will lose the kids..etc etc.....
    Everyones situation is different.
    The penalties or actions that follow will depend on many things like the amounts of money involved,the circumstances of why you failed to report,and also your co operation.
    There is discretion on whether they will choose to give you a warning and chance to repay anything back that you was not entitled to-or whether they will take it to a magistrates Court.
    I can only suggest that you follow your head and your conscience-it wont go away and better to come clean and have that taken into consideration.
    Of course at the end of the day its up to you.
    But I think the reason that you came here,was for a little advice-if you tell the truth then you will at least be able to sleep.Keep us posted on the outcome,although you wont know until later,you maintain that theres been no financial gain,so you are only guilty of failing to report a change in circumstances/or tell them that you had a partner living with you.
    If you can satisfy them that there was no financial support from him to you,then all well and good-but dont forget that they must have some information of their own since they have decided to investigate !!

    I suggest you contact your local welfare rights and check on Start Calculation what you should be claiming as a family - you will probably find that you are entitled to more. Why can your boyfriend not work even if it is part time?

    thanks for the replies , i am worried cause he has been living with me, but all they gotta do to see im telling the truth about him not working nor claiming is to look at his national insurance etc , my son has 24hr care and with the other 2 is very hard even wth both us looking after him. its the fact that i lied about not knowing who the dad was that worries me really . the reason i lied about him being the dad and living with me is i was told they would make him go to work ,and its very difficult to cope even with him here.like i said i didnt even claim cb or income support for my youngest for over a year ,and i didnt want to say i didnt know who the father was. but when i did claim, this is when i got the letter. is it better to just come clean about the whole lot ?i feel it would be . ive been worried for an age. they will know i didnt do it for money gain they can find that out by checking on him .still worried sick thow

    If you arent able to offer ANY explanation,then it makes them even more supicious.
    Much will depend on you being open.

    thanks martin, i will let you know. im going to ask for a interview b4 the one they have given me cause thats not till later this month , and b4 i decided to come clean i was just going to put a fresh claim in with bf on it legit wise.but then thought about it all . because i told them i had change of circumstance in the week they have sent me fresh claim forms ,,but b4 i fill them in i think i should own up first . do you think i am doing the right thing by owning up b4 i fill in the fresh claim? i hope they dont stop my money i have 3 children.still worried

    I cant tell you what to do covmiss-but it would do no harm as has been suggested to have a quick word with your welfare rights office-they get paid to do this job and it wont cost you anything !
    If you are unsure who you need to speak to,let me know and I will get a contact for you.
    I can see what you are suggesting-its hard to know if it will make matters better or worse at this stage.A couple of years ago-they would abandon an investigation if it prompted people to change a claim or cease it.
    The idea was that they had acomplished the aims.
    Pursuing an investigation after that happens can be more costly to them and time consuming-but of course its different now because they have been given more money and resources to tackle it-and also they have to meet their targets.

    Welfare rights officers are part of your local council- they often handle appeals for people who have had their benefit stopped and are not part of the Social Security/DWP. Just ring your local council and ask for the welfare rights department or look on the internet page of your local council under the advice and benefits section.

    They have generally heard it all(!) and should be able to tell you what you need about the money side and what the DWP can do regarding sanctions while not affecting your children.

    Do you claim Carers Allowance for looking after your child,??
    if you do then you could have claimed for him from the date your partner moved in and that would have been fine you are entitled to claim for him

    If you dont receive Carers Allowance then you have been missing out on extra money and premiums
    If your son has DLA middle Care or above you could claim Carers Allowance now and it then you can add your partner to your claim

    Tell them your son has DLA you are entitled to extra premiums for your son if they dont already know and you are claiming income support for him If you are receiving tax credits instead for your children tell them ,

    hope everything goes well for you whatever you decide to do
