    Default Firstplus PPI reclaim - advice please!**WON**

    Having read with great interesticon the comments and advice on this site, I have recently written to FP claiming that my PPIicon was missold on a loan taken with them in 2003.
    The PPI is still within the 5 year period before it expires, so can someone tell me if I should cancel the policy to get any refund due from that, even though my PPI misselling claim is still pending?

    welcome to the PPIicon forum.

    Having read with great interesticon the comments and advice on this site, I have recently written to FP claiming that my PPI was missold on a loan taken with them in 2003.
    The PPI is still within the 5 year period before it expires, so can someone tell me if I should cancel the policy to get any refund due from that, even though my PPI misselling claim is still pending? IMO I would cancel BUT only if you have alternative cover should you fall ill!!
    If you have alternative cover and cancel make sure your cancellation letter goes at least recorded if not special delivery.

    Your PPI mis-selling claim will be affected but only by the fact any rebate you get will be taken into account when you win and settlement is made.

    In my cases I went to the fosicon with two complaints on seven cases of mis-sold PPI. All were upheld by the adjudicator. I am awaiting result of complaint Number 3.

    The FOS advised me when they informed me of the result that I should cancel PPI if I had not already done so but did point out that I would then have no cover and that I should make alternative arrangements to ensure repayments on loan could be met.

    If you can post more information it would help to obtain further advice from PPI forum members.

    I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

    Bank charge successes:
    Halifax - Full settlement incl interest.
    HSBC - Settlement, goodwill no admission of liability about 75% of claim.
    RBS - Settlement, goodwill no admission of liability about 70% of claim.
    2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
    PPI Successes
    PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
    2 claims settled in full with LV without FOS involvement.
    2 claims settled in full with HSBC without FOS involvement

    PPI Claims ongoing with:
    Cap one Now with the FOS
    Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
    LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

    1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

    Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

    Thanks for your interesticon in my posts! It is great to know that there are people fighting for what is right out there!

    I have followed most of the arguments used by Angling_Man so far, as I am sure my PPIicon was missold along same lines - I already had cover through work but they did not ask, it was added to loan and pushed as being the quickest and easiest way to get the loan.

    Despite everything else, it simply cant be right to sell PPR to cover 5 years of a 20 year loan, but have me pay for it for the whole 20 year term?!

    Just to let you know - I won!!!

    One letter, and all settled within 6 weeks from start to finish.

    They upheld the complaint on the fact that the sales advisor at the time of the application did not make it clear that the PPIicon was optional.

    They have refunded 6.5k premium plus 2.7k interesticon back to the loan and restructered the loan as though PPI never existed, and have refunded 2.8k to me in a cheque!!!

    FP were really helpful in my case.

    Its definitely worth a letter and asking the question!

    Congratulations!! Well done this is great news. I have today had a reply to my 2nd letter they refused ro uphold my claim in reply to the 1st. This time they are saying my comments have been noted and they will provide me with a full reponse by 24/2/09. I don't know if thats good news or not.
    But your success gives the rest of us hope.
