    Default Capital One PPI ......my next step?

    Can someone please give me some advice as to my next step in trying to get back my PPIicon payments from Capital Oneicon. After my initial letter and spreadsheet demanding the refund of these charges Capital One sent me this letter:

    How were you mis sold? And what year?
    I was sent the exact same letter and I currently have complaints for charges and PPIicon with the fosicon.

    2004 to 2007......I had two life long handicaps that were never enquired about and I had recently lost my job just a few weeks before. So it would have been near impossible to make a claim for any circumstances arising from illness/disability or unemployment. I was never told I could find this type of cover at a more competative rate elswhere if I looked around!

    I am assuming that you told them this in your first letter, so I suggest you write back and say that you are not happy with the response and repeat why the PPIicon was not suitable ,so could not have been sold properly.
    Remind them that if you are not happy with their next reply you will be going to the fosicon.
    You can take the complaint to the FOS 8 weeks from your first letter or when Capital Oneicon give their final response.

    Did they send you a needs and assessment questionnaire to fill in so they could ascertain the suitability of the product they where selling you if not you should include this in your next letter.

    hi jendoc
    you have not indicated wether you have a copy of your application and copies of the insurance etc, cap1 will say anything just to delay and will only comply if they have to,
    have you done a data protection request and demand transcripts of all the calls etc.
    you will need every bit of information if you are going to win.
