Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I was previously in the A & L bank group and am delighted to tell you that I got all my bank charges back so am now in the process of claiming them back from the Nat West aswell. Sent a Cheque of for £10 and a request for all my bank statements on the 4/7/06 and as of yet have heard nothing, oh what a suprise!
will keep you posted as and when things start to happen.
Just a quick update. Received all my last six years statement and was actually suprised that I had not incurred as many bank charges as I thought I had. . Needless to say though they still added up to £775,25 which is a tidy sum. Anyway, sent my 1st letter off on the 14th Aug (received by them on the 15th Aug) so am now just waiting for the 14 days to pass. Will keep you all posted as and when things happen - Tallie Hoe.
Great to hear from you, hows things? I have had a reply to my letter lba saying only that they had responded to my 1st letter? Anyway needless to say its time to do moneyclaim, I am wanting to leave it for a few days yet - I have a lot going on at the moment and contrary to poular belief us girlies can't always do a million things at once! I will probably get my head together and do it at the weekend tho. They have stung me for another £60 since my LBA letter so i shall be including that in my claim - I only wish it was enough to get me out of the rat race and buy me a little hut somewhere nice and quiet! Will keep you posted as to events so until then take care.
Hey Weaver, not a very talkative bunch are they this Natwest lot? Just me 'n you kid!
Popped in again from A&L to see how things are going for you. You're sounding a bit stressed there, hope things are OK with you apart from having to sue banks that is!
Keep your chin up, dudesse, stay strong.
[p.s. It was not my intention to offend all you nice NatWesters, it was just a joke between two former A&L compadres, after all were all in the same boat - innit? No hard feelins guys!]
Don't worry, we're all watching. Looks like we've got an expert at work here!
The guys in the forum here usually pick up any questions or problems pretty quickly, but due to the volume of claims they can't comment all the time on everything.
Weaver, I hope someone answered your question re additional charges since lba. The answer is yes up to the point of filing a claim. younganfree- Love the name
cannot believe its taken me sooooooooo long to finally to get my a**e into gear and file a claim! One quick quessy tho (dumb). If the bank charges are less than a £1000 before the interest do I pay the court fee for the under £1000 or the fee for the over £1000 as it would be after the interest has been added. I didn't have to worry about this with the A & L as it was a much smaller amount. I have looked in the FAQ and even have all the bumf from the courts but no mention in the Fees leaflet! Can anyone help me please - really want to do it this weekend, have wasted enough time already!!!!!!!!! Thanks for any help.
Hi, Weaver, sorry this is a bit late, I've been away - hope it isn't too late to be of help to you.
Bearing in mind that this is only my opinion, I'd say that as the amount of actual charges you are claiming back is less than £1000 you possibly only need to pay the fee for that amount, because this is the sum that is actually in dispute.
The rest - interest, costs, etc. - could presumably be considered incidentals.
As I say, I'm not too sure, but I think the court would soon let you know if you were in error, don't you agree?
Hope you have been somewhere lovely? Glad you're back and thanks for the reply. I decided if in doubt the best option was to send the larger amount, at least then there would be no reason to for things to get held up. AND after all I will be getting it back Me Hopes!!!!!!!!!!!!!! Will take a look at your thread later today and see how things are going for you. ;-)
I DON'T BL**DY BELEIVE IT (Hope you like my Victor Meldrew impression - infact its not so much an impression more a realisation that I am becoming more and more like him) HEEEEEEEEEEEEELP!
As this was the biggy claim for me I decided (eventually) to go to the courts and do it on paper rather than MCOL (more space to write). Any way they have returned my cheque for £120 and all paper work bacause the cheque was made out by a third party for and on my behalf which is not allowed!!!!!!!!!! No explanation as to why its not allowed. Anyway, it means a bit of a delay but will go into the courts again on Friday and pay the £120 cash. So be warned, if anybody is thinking of doing the same, the cheque has to be issued by the same person making the claim.
Cheers
You are right on both counts, especially about Nat West, they definately appear to be taking the longest to settle and are the hardest Nuts to Crack.I don't expect to be seeing any money this side of xmas. However, at least after xmas i might have some money!!!!!!! which would make a lovely change.
How you doing? I was only joking about the victor meldrew bit, I am an extremely positive, happy go lucky person, and It will take alot more than a few scummy *ankers (OOHHHHHHHHHHH naughty) and court clerks to get me down! Now, where did I put that bl**dy shotgun?
Well, finally delivered my claim to the courts on Friday 3rd Nov and paid the £120 in cash so hopefully there will be no more delays! So I guess for now like many people before me its just a case of waiting patiently - will give updates as and when things start to happen.
