I recently lost my job and have had to go onto JSA. A week or so later I recieved a letter say they were going to take £30 a week for an overpayment from 16 years ago. I know that they are not covered by the Stature of Limitations as normal debts are but is there anything I can do?
There has never been any sort of correspondance regarding what was owed and £30 a week is about a quarter of what we get a week.
I phoned them and got it down to £25 but they refuse to take it lower.
They still have to prove the amount owed and that it is something which you would have to repay - i.e. not their mistake. I also think there are limits to the percentage of your income which they can take.
I would put everything in writing straight away - ask for proof of exactly how the overpayment arose and the amount involved. I would also phone again and mention 'causing extreme hardship' to try to get the repayments reduced some more. You may have to insist on speaking to a supervisor.
