Firstly, I would like to congratulate this site and its members for the great work they do and for the advise and help they offer each other. This is the reason I have decided to start this thread in the hope that I might get some advice, support or also might help someone else who is in a similar boat with their problems.
May I also say I used to work in the Finance industry so come into this not as a layman but someone reasonably educated in the workings of a finance company. This is my story:
I have had issues with Welcome since September 2007 when they openly discussed my finance account with my wife without consent. I complained about breach of DPA but was ignored for months. I eventually took the turn of witholding payment to get their attention and then received a barrage of abuse and threats.
I eventually got my complaint registered but then dismissed as I could not give the name and exact time of call to the operator in the complaints team so she could listen to the call to decide if the breach took place.
I appealed against the ruling to be told to get lost in no uncertain terms and a final response was then issued stating exactly the same as the initial response. Welcome have not had any payment from me since 1st April 2008 due to their repeated closed ear policy and unwillingness to adopt any form of complaint registering policy or framework.
I write this thread in the forum today as I undertake two courses of action. The first is a Subject access request as I want a copy of the phonecalls she could not listen to and also notes on my account which should specify the exact time and operative who made the call as part of the audit trail. The second as I attempt to voluntary terminate the agreement under section 99 of the consumer credit act.
I do not hold out much hope of an easy ride as what seems to be the norm for this lot of losers is to threaten and intimidate and ignore every reasonable request and action. I will keep you posted as to my pogress and would really welcome and advice that can be given which may help me.
You must Subject access request them - mention all the things you want even though they know what they have to send you. Don't forget the tenner.
Make sure you mark the back of the cheque 'for payment of Subject access request only - not to be credited to the account'.

do not correspond with any welcome local office, trained monkeys come to mind, they would have no clue what an SAR is
send all correspondents to this address, and most important, recorded delievery.

Thanks guys for the advice, I am going to be very careful with this and eventually I hope to hang them out to dry and get some compensation for my time, effort, distress and inconvenience. The letters went recorded delivery today so lets see what occurs when they arrive.
They have tried to call me 7 times today but I never answer their numbers as they are saved into my phonebook on my mobile. I think the comparison to apes is being kind, monkeys at least have opposable thumbs and portions of brains in excess of amoebae.
One of these idiots had the cheek to call me a thief the last time I spoke to them as I will not give him money, I advised him to take me to court and hung up. I hope they have that call recorded as apparently they record all calls and note every conversatiojn onto their database - Yeah right.
I will post again when I get my first contact and I got the letters I sent were linked from this site from Natinal Debtline.

FORMAL COMPLAINT UNDER THE CONSUMER CREDIT ACT 2006 COMPLAINTS PROCEDURE

I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.
I have verbally requested that these stop, but I am still receiving calls. (Delete if necessary)
I now require all further correspondence from your company to be made in writing only.
I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.
If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.
Please treat this also as a formal complaint, and send me a copy of your company complaints procedure.
Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)

If you asked for the recordings you would probably find that (conveniently) the recording machine was broke or down for maintenance that day.
That is why they say 'may be recorded' so they can ditch the bits they don't want to own up to and claim it wasn't being recorded.

I have received acknowledgement of my SAR today dated 9th January 2009. No contact yet regarding my VT request though I keep getting calls from an automated message system to which I answer and is states "This is a message for (my name) from Welcome Finance. If you are (my name) please press one now." at which point I hang up.
Will give them until the 25th then I will write to them again asking why they refuse contact regarding the VT. The thing is that while this is being ignored, I am becoming liable for more money as there is no agreed date of termination.
Does anyone know how I can get this sorted with a bit more haste?
Two letter to Welcome later and still no response about the VT. They have returned the SAR but the account notes wer transcribed and typed out on word??? Absolute joke. I am sending them a final letter advising that in 28 days the car will be left outside the local branch and the keys posted thru the letterbox as I am sick of it being on my drive.
Anyone got any advice? I cannot understand why they are ignoring me and why they have not contacted me when they are not getting money.
Received 3 phone calls in 15 minutes today from the branch who demand payment from me and tried to tell me I have breached my ontract and I am going to court. BRING IT ON!!!!
I asked politely at first about my letter in January but did not disclose the content. They are adament they did not recieve it even though I have it signed for on the 9th January by Head office. I told him to go away and write to me and hung up to which he proceeded to phone me back and was very arrogant and rude again threatening court action unless I pay. I politely told him to go away and stop phoning or I would have them done for harrassment and again hung up. To my surprise he called me straight backand told me I was only making it worse for myself. I did not reply and hung up.
I am now sending the above phone harrassment letter along with my 3rd letter requesting termination of the agreement.
Iam soooo mad with this lot. Trained mokeys would have a better understanding of human behaviour and courtesy than these lot. I want this to go to court now as I want to hang them out to dry but I need to challenge them about the SAR first as the information they provided is a joke. The notes from their "system" are typed out on word and half the telephone calls I had with their staff members are not even noted onto the system.
Any advice at this moment will be greatly received.
