I took out an Egg loan in 2005 which was obviously done online.
I was under the impression that after 2004 a tick in a box sufficed for a signature and that no actual handwritten signature was required.
However I have just been going through some old papers and have found the original cca agreement (both copies) one for me and the one I was meant to return to them. Why would they have asked for one to be returned if it wasnt necessary?
Can anyone tell me if this is likely to be enforceable? One thing I have noticed although unsure if it matters or not is that the agreement points to a number of clauses ie. (see clauses 5,7 & 10) however these are on a seperate t&c sheet and not within the signature pages. Not sure if that affects the enforceability or not though.
I think you need to write to Egg and ask them for a copy of yor agreement. They are normally good for sending a copy back. Or if it was signed online, I guess they will tell you that?
Are you sure it was online? They did a lot over the phone. I don't see why they would have sent you something for signing if it was done online.
I can't think of any reason why this agreement is unenforceable unless they don't have a signed copy (unusual for Egg I think)
I had an Egg card which i swapped to an Egg loan in 2005.
I cca'd them and got nothing for months, eventually i got a copy of an online agreement with a tick as my signature. However i do have an email from the time from Egg, telling me to return the signed agreement to complete my application.
I have just written a letter back to Egg, asking for screen dumps of the loan screen if i did it on line, also asking why would they send me an agreement to sign and why would they not complete the loan up until the time they received the signed agreement back. In my case, i think they are trying it on. But if not, my online agreement is enforcable, just dont think its a copy of my actual agreement.

A screen dump was produced in court and accepted by the judge, resulting in the only court defeat ever reported by an Egg claimant.

becasue it's an online application other things come into play.
online application details (screen dumps) showing you accpeting t and c's and tick bopx or printed name etc are accpetabl.
most compnaies still have the please sign here bit even though it is not required with online agreements
