Please can anyone help me, i have 2 defaults placed against my credit file by Egg. One is for a loan £12500 and one for a credit card £5500. They were placed on my file in Mid 2004. I went through a debt management company (greg penningtons) after getting myself into a bit of financial difficulty late 2003 (Used GP as i didnt know were else to turn). However my circumstances have completely turned around and i paid all the debt off in full in April 2008.
I want to try and get these removed but dont have any idea were to start or if this is even possible? as it is causing me big problems.
A Default Notice is recorded in your CRA for historical reference and the benefit of other institutions contemplating business with you. After a debt is satisfied you are entitled to request Egg to pass on this info to Experian et al for publication, but not to eradicate all traces of the DN. All traces will be gone in 18 months any way, as your DN reaches the 6 years milestone.
I'm afraid I have to second what Mistermind has told you.
However, I wonder if it would be any consolation to you that you might be entitled to some refunds from Egg? Have you claimed back your penalty charges for the Egg Card yet? This is VERY easy. Then you can think about any payment protection insurance that was added to the loan (and possibly the card) and have a go at claiming that back as well.

Looks like DN removal matters more to you than cash refunds on penalty charges? Have a butchers of the following, and send a polite Private Message to the poster should it be relevant to your situation:
This is just one of two cases I have read reporting successful Egg DN removal (the other one was a legal technicality irrelevant to you). This was a case where the CCA looked to be unenforceable, but the cardholder like an honourable chap settled in full any way when he came back into funds. I think Egg management was so grateful and relieved that they volunteered to remove his DN, no questions asked.
You unfortunately have now settled in full, so no longer have any levers to pull. However if you have substantial unlawful charges refund due, but the black mark will damage you more than refunds will benefit your pocket, then you might like to sound Egg management out for a little horsetrading, i.e. if they lift your DN you undertake in writing never to pursue your charges reclaim.
For this to even stand a chance you will need to clearly establish how much itemised reclaims are due and you therefore have something credible to horsetrade with, and you will also need to establish contact with Egg Manager, not the £6-per-hour telephone monkeys manning the front desk (Egg have over 2 million cards). Establishing the charges refund due is the easy part, as Egg no longer puts up serious resistance to those who know they will pay, such as those who read this forum.
With their owners the Citigroup now head just above water thanks to USA government bailout, and with austerity no doubt now in force in Egg House, any money-saving idea may be well received by them. Removing a DN will cost them nothing, but for sure they will not do it for nothing.
Thanks Mistermind for that, you are absolutely bang on regarding the defaults v's money back. I really need the Defaults to be removed so it's worth pursuing the negotiation route. Not sure were to start but will have a look through the forums.
