I'm after some help and quite quickly please (dont mean to sound rude)
I brought a car in november from a dealer (with reciept to prove), and have just come to sell it as we dont need it any more and I have found out the cars mileage has been clocked back from 125,000 to 62,000!
I have found out that although it is not a crime to adjust the mileage it is however a crime and fraudulant to sell a car without telling the new owner!
I found all this out about the mileage change from a site my friend told me about run by vosa. Checked it all out and found out this!!
According to the site the car had an mot done in may 08 with 125,000 miles on it which would have been valid until may 09. But then has had another mot done in november 08 with only 61,000 on the clock which is the mot the dealer gave me!
Since finding this out I have also worked out that the service history book has also been tampered with! Although all the stamps are from a main dealer all the dates that have been written in have been lightly scrubbed and re written over...very clever how its been done! I never noticed it and I have brought quite a few cars.
I feel so foolish and what makes it worse is I have been transporting my partner and 1yr old daughter about in it...makes me wonder what else could be wrong! I did a basic HPi check on it when i brought it and all was ok...i just didnt pay the extra for the mileage check colour check etc as I didnt feel I havd to...and also not having much money being a young family i needed to hang on to my cash!
I just thought with an mot, a service book, 6mths tax a reciept from a dealer and a basic hpi check all would be ok!
My question now is this....what laws...if any...am I covered under and what can I do about this. Is the SOGA act any use to me??
Should go down to the dealers and surprise him or call him and give him a chance? I did go to ring him and started to say i brought a car etc and had a problem with it and my partner said not to so I put the phone down. Since then the guy has been trying to ring text and pester me to find out what car it was etc. Sound very dodgy to me!
I have also found out he trades under three different names that I have managed to find out and has another two landline numbers I wasnt aware of and another new mobile number!!
He even had the front to advertise this in the autotrader!!!!

Yes, write to the dealer with copies of all the evidence you have and ask for all your monies back, give him 14 days to repond or you will take him to court under SOGA; the car was missold, and mis represented due to the incorrect mileage( dealers responsability to check if not correct and tell you, but he may have done it!) Also say you will report to trading standards, illegal to tamper with mileage and they may take him court as well.
See what transpires if he responds.
If he does phone, confirm any agreement in writing.
