Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have today cancelled my broadband contract with AOL. The reasons being:
They took 4 DD payments in July, but deny doing this (I have sent them proof).
They deny taking payment in October (again, proof sent).
They failed to take a payment in November/December.
The cheeky bar-stewards then tried to take almost £60 out of my account on the 30th December - without telling me! I explained the DD guarantee to them but they deny trying to take this amount (I have proof, but not sent yet).
Now, AOL have kindly told me that not only will I have to pay the outstanding £60ish (which I don't owe), but also a cancellation fee of £56.
Is this typical of AOL? And is there anything I can do?
Best thing you could do is send them a formal complaint letter via legal aid with photocopied evidence which is signed by a witness or stamped by the manager at your bank/building society.
This happened to a neighbour of mine a few years ago and AOL were charged for fraud - if i find the details i will pass it on to you.
Keep your original evidence - thats the most important thing!
When my neighbour had this issue with AOL she went to legal aid as they had taken to many problems and denied it - she was interviewed and all evidence was photocopied etc
I need to phone her and i can send you what exactly happened - im sure it was legal aid she had to do this via as she was only on the £14.99 a month contract but they were taking about £50 a month frm her.
i would send them a letter by recorded delievery
head it complaints dept
tell them the sp as to your first post
confirm to them that under the situation the account is terminated due to breach of contract
i had this run a roung when aol first started broad band
they supplied a lousy modem, they did cancel in the end
the worst part of this will be getting rid of aol out of your computer
I have sent them proof, but isn't the onus on them to PROVE I owe them the money. Anyway, I will send a letter on Monday outlining all my problems (omitting the bar-stewards bit ), give them the proof and hopefully they'll leave me be.
Hi Pauandgay - Was AOL charged with fraud? Could you forward me the details of that case aswell?
AOL like to take money from your account then deny all knowledge of doing so (I have proof of this and I am tackling AOL about it now). The latest one with them.....they took almost £60 from my account without telling me. I did not even owe them that much. They also deny this.

Thank God for bank statements
Same here - they deny they could find this charge for so many months - so continued to billed me.
So I am going to take them to court. I'm just waiting to get info back from my S.A.R I sent them yesterday.
