Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Just realised yesterday that these gits have probably banged a load of charges on accounts that I used to have with them, so thought I'd try do something about it.
Now I don't have the account numbers any more so rang clydesdale but they had no record of me at the address which I took the account out at?!? They suggested I contact the bank for the details of the direct debit which I have just done (and tried to do for time ret finance as well) now the bank has no records of these direct debits but I have my bank statements in front of me with these direct debits coming out of my account.
My question - how do I get the account details and is the bank in breech of the direct debit guarantee/data protection for not keeping these details for six years (it was 3 years ago the dd's)?
Also how should I proceed to get the account details?
I've also spoken to Time Retail Finance today (also have no account number) who have told me that since my account is closed they no longer have any of my details!! What rubbish. When I pressed them harder they suggested writing to the Corporate compliance dept with my SAR.
Send the Data Prot SAR letter, enclosing the £10 and all your details and let them do the running around finding your old account, just sit back and dream of what you'll do with all that cash!
Am I right in remembering that they used to charge £50 for late payment?
hi there
i've been trawling the threads looking for someone who is tackling TIME. I managed to find 1 old statement, phoned them, and they told me it would be £1 per sheet for my account transaction details. will now request info via DPA (SAR) letter.
These b*gg**s caused me tremendous stress, and only earlier this year i finished paying off the debt via a credit collector which has taken 4 years.
Bad times!
But now we have the power.
Good times!
I'll be following your thread, maybe we can compare notes along the way.
the train of thought has left the station, hope i was on the right platform!!

Account at address xxxxxxxxxxxxxxx For direct debit amount £xxxxx Direct Debit in effect from Oct 2002
Please supply me with a complete list of transactions and charges relating to my banking history with your organisation. Alternatively, a complete set of statements for that period will be acceptable.
Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my banking business with you.
If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response.
I enclose the statutory maximum fee of £10. You have 40 days in which to comply. Furthermore, if I discover that you have levied disproportionate penalties against me, then I shall be reclaiming them, and also reclaiming the enclosed £10 Data Protection Act subject access request fee.
If there is specific information which you require in order to satisfy yourself as to my identity, please let me know by return. However, please note that the above address is the one which you normally use to communicate my private business to me and which you have hitherto found to be acceptable.
Yours faithfully,
Oh and are they gonna be funny as I'm now at a different address to the one I'm asking for details from?
hi blacksheep
i've just done a SAR for my partner. on the bottom of the letter i just put 'the address at the top of this letter is my current address, to which you can communicate my private business'.
As to no account no. i'm sure they'd be able to retrieve the info from your previous address. i'm pretty sure they have to hold info for at least six years for just this purpose. (but don't quote me on that :-|) and an SAR should do the trick.
I would say once you send the SAR the ball is firmly in their court to supply the information to you.
best luck

Now I have a lsight other querey - as Clydesdale finance have no record of having any dealings with me, how can they justify the default on my account?
Do I just write to them stating pretty much the above - that as they have no reccord of having a contract with me then they have inaccurately put something detremental on my credit record - and can I try claim compensation for this?
Well If I'm not on their system I'll be trying to claim back the £1k + I've paid to them as if I don't have a contract therefore no reason to have given them any money - starting to hope they have lost my details now
I'm compiling a Store Cards contacts list to make things easier for future claims.
Addresses for both Time & Clydesdale Finance would be great if possible...
Thanks

Yeah right, hadn't though of that. Hope they've lost mine too! We both had an account with a limit of £2.5k each!!
hi. i will be starting my own thread on this but i do have a question. i have received a load of printouts from time along with a note of explanations for the abbreviations. it says that the document CES3 has details of any arrears etc. there are system copies of my monthly statements which i should be able to read easily, but i cant understand a word of. i cant seem to find any charges, which i know i have a fair amount of, but if i cant find any how can i work out what they have charged me? :-? :-?. does anyone know how much they charge for an unpaid direct debit and a letter? ill have to go through the statements again and see if i can figure things out but this info would be a great help as i would at least know what to look for. does that make sense?
thanks for any help received
Hi Chilli, did you have your account through Clydesdale Financial Services? (Address as in Glasgow 10000 Academy Park, Gower Street, Glasgow G51 1PR)
I have had 2 accounts now sold on (alledgedly) to Capquest and Cabot.
Looks like they are panicking as to the whereabouts of the originals of deeds and agreements! Send a letter to the above, and you will receive your statements and a load of sheets with codes etc on them. ignore the codes etc, this just tracks the phone calls and letters sent to you. i am now claiming just over £1100.00 for the 2 accounts.....they have until Wednesday to reply to my Prelim letter and then it's my L.B.A.......roll on the 26th......i,ll keep you informed.
Cheers T.D.
