Does any one know my rights to cancel with this provider (tiscali) before my contract with comes to term.
Since being with them I have had no end of problems, over charging, paying twice in the same month, slow speeds, loss of connection.. the norm really.
Im on their max package and should get upto 8megs.. my line can carry more, up to 19mb. But im only getting 1/2mbs. if I was paying for that speed I wouldnt have a problem apart from the dropped connections etc.
Surely if they are not sticking to their side of the bargain, should i not have the right to cancel??
I have asked customer service what woulod happen if i canceled and they said i would have to pay for the rest of my term with them which is may 2009. If I didnt pay up they say I may not get another provider because i would be classed as a bad debtor.
Any advice.. And is there any good providers out there that dont rip you off.
Have you complained about the service you've received? If you're going to do this, make sure you put it in writing.
Have a read through your T&Cs too It also might be worth ringing another ISP and asking them whether they would take you on in light of all the problems you've had with Tiscali. As far as ISPs go, why not ask friends who are local to you to see what sort of service they've had with their ISPs. Obviously, it really depends on how close you are to BT's exchange and whether cable is available in your area too.

I sued tiscali for cancelling my service after 3 months.By law a contract works both ways, they are not sticking to their side of it, 'google' it, there's a lot of information on contracts out there.
I'm no lawyer, but this is what I would do.
Stop your d.d. with them, but first send them a registered LETTER (do not phone or e-mail) giving them a months notice telling them of your intention, something along the lines of their overcharging,poor service etc.,but don't make assumptions or allegations ( keep that for the court if it should come to that, don't give them something to work on),keep it short and simple.
You probably won't get a reply,if you do they will say you have to honour your contract,reply with a reference to your first letter and leave it, if the letter threatening court comes answer it simply that you are prepared to meet them in court,or it will be debt collecting agency, tell them that the case is in dispute and refer them back to tiscali, from the debt collectors point of view that should be the end of it, anything else is harassment.
Remember that they cannot send bailiffs or impose a ccj,bailiffs and ccjs' are sent by the court AFTER your failure to pay any fine or payment imposed by the court.The worst that could happen is that you lose the case and have to pay up in which case there is no ccj.

I've been with Tiscali for approx 6 years. Just gone downhill, used to get between 7 and 8 megs regularly, can now only download at 3rd of a meg. I'm not a big downloader, have heard of a "naughty boys pipe" but have never had any warnings about useage. So decided it's time to move, not easy, Tiscali wouldn't give me a MAC code, and no other ISP seem to be able to connect to my number unless I get BT to take the line back, which means being tied to BT for another 12 Month contract. I've had no choice, I really wanted to go with Sky for everything but the just couldn't do it as my line had been "hijacked" by Tiscali....be warned !!
oh no!! surely they have to give it to you.. oh well im moving soon.. i just wont tell them, will just cancel and fight them after that.. seems to be my only option here
Good luck, I've had no choice but go with BT, I've heard BE Broadband are a good isp with very fair useage policies. I really wnted to go with Sky though as it worked out a good package if you took the lot, TV phone broadband etc..

my daughter has just gone over to sky with a fab package its well worth looking into me thinks... my son has it too and he has never had a problem
you can still get the Sky talk CPS product and Sky BB can't you? BT Only tie you into the contract for the line rental side of things, there is no financial penalty for switching the telephony side of things. Then after the 12 months, switch to the Wholesale line rental Sky product. It's better than nowt....
Hi. I know exactly what you're going through. tiscali are an absolute nightmare who couldn't organise a proverbial p**s up in a brewery.
I can only re-iterate what others have said on here. Definitely read up on the T & C's of your contract, it definitely works both ways. I'm sure you'll be able to find something in there that essentially says they are not sticking to their end of the bargain.
Unfortunately the call centre is worse than useless so be prepared to be fobbed off with every imaginable excuse under the sun just to get you off the phone.
Once you have your proof in the T&C's, you will have to go through their complaints procedure. Invariably, they wont get back to you, so when you do decide to go elsewhere and should they try to get funny with you. Present your evidence and start talking about their "breach of contract". That worked for me.
The only kicker after that is they could play silly buggers about removing their markers from your phone line as while they are there, you cannot migrate elsewhere.
Just got rid of pipex.....(tiscali now) As soon as tiscali took them over they went CRAP !!!! customer service was a joke and speeds dropped
I'm now on o2........had some problems to start with but they were fixed quicly enough. very polite and the customer service was excellent...they phoned me back to ask if was happy !!!!

on another tack....even though I migrated tiscali keep trying to bill me and seem to think I have my phone with them as well ???? kept getting letters saying that they would cut off my service.......??? idiots
surely, if the speeds we're all getting are consistently slower than dial up they are in breach of conract calling the service "Broadband" I checked again last night, mine's sped up to 400 kilobits per second now whoopee !!!
