My work colleague got a car through Car Craft (silly boy) and they are now harassing him all the time about servicing said car (I have told him to send the harassment by telephone letter). He has been told by Car Craft that he HAS to get it serviced there. However, in his t & c's it only says that if he doesn't service the car at Car Craft then the warranty will be void. He's not to be bothered about the warranty as it's not worth the paper it's written on.
Are Car Craft just trying to pull a fast one? His car is in need of servicing, but he wants to take it elsewhere.
Is this a warranty 'bought' at the time the car was purchased, and was it a condition of the finance that you bought a warranty ?

As far as I know the warranty was part of the purchase (i.e. he got a 2 year warranty from car craft). I don't know if it was a condition of the finance as I'm asking on behalf of a work colleague. Does this make a difference? Like I said, he isn't bothered about the warranty, but wants to get his car serviced. However, Car Craft keep telling him he has to have it serviced by them (and barrages him with phone calls constantly about it).
I will double check with him tomorrow about the conditions though. If he HAD to have them for the finance to go through, is this part of the mis-selling thing?

It certainly is misselling. The two are not connected and they cannot insist on one in order to qualify for the other.
See also if he has a Breakdown of what the warranty covers and does not cover.
Bought warranties are not covered in the regulation change of 2003 that said you no longer had to take a new car to the dealer for servicing in order to retain the warranty.
Warranties are only an extra and cannot be used to reduce or take away your rights under the sale of goods act. If it was bought he will find it next to useless anyway. They are one of the biggest insurance [problem]s of the century.
If he is not interested in their warranty, then by all means go elsewhere, but make sure it is done at the correct mileage and retain all receipts.

Thanks - I will get him to bring in his agreement so I can have a scan through it. He only got the car 15 months ago so I guess he comes under the regulation change. If it was mis-sold, where does he stand on this?
Oh, he is within mileage, so I will tell him to go ahead and get his car serviced

Brill......but how does he PROVE he was mis-sold? I got compensation with Brighthouse for mis-sold policies (without proof), so would this be the same kind of thing?
