Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
My dad brought a Rover from a car front in Brockley, SE4, however, he found there were things wrong with it. The car front owner said that he would fix it and let my dad have the car back. When my dad collected the car, it worked for about two days and then started loosing power. My dad when back to the man, who started to become abusive. He even returned there with my brother but his colleague said he was out of the country. My dad returned there about 3 wks ago and was verbally abused and threatened by this man. After my father left, he was approached by another man from a car front further down the road, who informed him that the man was a rip off who sold cars that did not work and Police had been to the premises on many occasions due to irate and frustrated customers who wanted there money back. My dad's car now does not work and he has spent over £2,000 on it. Is there anything he can do?
The first thing you do is to list all the faults with the car, the dates it was in for repair and then write a letter of rejection listing all those things.
You site the sale of goods act giving you the right to reject any vehicle that is not of merchantable quality and fit for purpose.
Tell them where the car is and remind them that it is their responsibility to come and collect the car.
Tell them they have 7 days to collect the car and return your payment (in full) or you will issue a summons ordering them to comply.
I would send this by registered post (expensive I know) because of his attitude.
If you taxed the car then don't forget to take the disc out before they remove it.
