Default Wakefield Express Don't Help Innocent Motorists

Over the past few months a lot of people in my home city (Wakefield) have fallen foul of the Private Parking Companies, many letters of complaint have been printed in our local paper (The Wakefield Express) who don't help the situation by use of the word 'fine'.

When will reporters bother to get their facts straight and stop reporting these 'invoices' as fines, I am sure many readers will get the wrong impression when they read the word 'fine' and assume that these 'invoices' carry more weight than they actually do.

Until the local (and national) press stop helping Companies like Excel (etc) by mis-leading readers the private parking companies will continue to have it easy.

    Excel parking by any chance??

Why did the council ever give the contract to these people.

Top tip for everyone in Wakefield is to park in the Ridings or a council run car park. Or get the train or bus. LOL

I think Excel have one of George Street and er one near the Theatre

The word "fine" would imply that it was been issued by a traffic warden or the police, and is not a civil matter.

    Like "bangers" and "sausages". LOL

I am also fighting excel - parked in symth street car park and did not put correct reg number in but do have my ticket - sent all the details off and appealed but they still say it is part of their contract that we input reg details - company car so did not know it - can any one tell me if this is worth fighting. Cheers hwadsworth

I'm in a similar situation now. Don't worry about it!! Superb the advice I have been given on here.

It would be a civl case so they have to have had hard evidence that you broke their implied contract as they can't issue a parking ticketicon. Only the police and people working for councils can do that..... like traffic wardens.

    Picture of the the driver?
    Picture of your car?
Picture of your car windscreen with no ticket displayed in your windscreen??

    Innocent until proven guilty??

Best thing to do is to do a serrch on excel parking in the forum, and read it all. Then make your own mind up.

Needless to say im my situation I have asked them for some evidence to prove my guilt that I have not purchased a ticket/have and invalid ticket and will be ignoring any threats I get though the post and storing them up as evidence incase they decide to goto court. You may be able to use the letters they send you as evidence of harrasment and fraud.

    Good luck

For them to win they would have to show a financial loss, since you did pay they have suffered no loss whatsoever.

I'd write to them stating that you are not appealling but merely pointing this out and that all future correspondence will be ignored, then do just that.

"Do you mean more weight than a festive snowflake!" ? - I think you do.

Now that would be a nice little quote for The Express to print now wouldn't it - lol (a much better statement of the truth)

Many thanks for the help - I am going to fight this one as it unfair and they should not be allowed to get away with this. I will point out to them that they have not suffered any loss and hope that will be the end - but somehow doubt it.

I am doing - just told them as they have suffered no financial loss there is nothing to answer so the matter is closed.(which was a reply I received last night and a good point). I will from now on ignore their demands how long do you think it will be before they try the threat of court action and will this effect my credit rating

You are right - I suppose they just hope you will cave in if they push enough and use their bully tactics. Thanks for the replies.
