Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Hi,
can someone please help my christmas not be ruined?! So i have an unpaid congestion charge that has now been passed to equita. They have clamped my car and are demanding an extortionate amount of money. Now I am happy to spread these payments over a period of time but the problem is i imagine they will want a huge amount to remove this clamp. The bailiff that has clamped me didnt leave ANY details on the clamp about who he was or how to contact him. Eventually I got his details; he doesnt answer his phone so quite how I am supposed to get the clamp off is anyones guess. HELP!
Oh, and the car is owned by a finance company, can they still clamp it?
Where abouts was the vehicle when it was clamped?
Do they have a warrant out on you from a CCJ.
If this was on my drive, that clamp would now be in a thousand bits.
unfortunately it was parked on a street which we have a parking permit for! I am unaware of any CCJ. Im starting to think I should attempt to get it off, apparently if i let the air out the tyre it may make it feasible?
THESE will do the job nicely, although id be a bit worried about laying out the best part of fifty quid for a one use jobby.
see if anyone you know has a pair and borrow them, it takes 2 minutes to snip the chains/locks off.

Then ask me!, I love writing complaint letters, because I can be just as pompous and arrogant as they can, only better!.
So in theory cutting the chains is not too difficult a job? Would rather not cut it, was thinking maybe i can pulll the face of it back enough so I can take the wheel off or something. But if worse comes to worst, 50quid is still better than letting him win! thanks!
nah, using bolt cutters is dead easy, just 2 snips on the chain securing the clamp to your wheel and youre done, all you have to do then is pull it off and chuck it in the bin.
im sure someone you know must have a pair knocking about somewhere, no point in spending £50 just to do that, well, unless they come back and clamp it again.

If it chain attached, then you will probably find that the chain has been looped through the suspension to prevent removal as you suggest.
As other have said - if its unidentified and without paperwork, cut it off.
cutting it off it is then! Im off to hire a pair of bolt cutters tonight and i have a feeling that mysteriously it may have vanished along with the car tomorrow. thanks for the advice!

if it has then there could be a possible claim there for damage to the suspension.
take pics of the clamp if possible and post them on here, ive had a fair bit of experience removing clamps so i should be able to see what sort it is and where you need to cut.

So its possible they damaged the car too?! incredible! basically its a plate at the front with a padlock on it, the chain goes either side of the wheel at 10 and 2 o clock positions if that makes sense?
yip, sounds like a standard cheapo clamp to me, just snipping the hasp of the padlock should be enough to free it.
before you cut the chain, just check to see wether they have looped the chain through your suspension/springs, if they have be careful unlooping it, otherwise you could damage the suspension or wheel arch.
make sure you take pictures of it before and after, just in case you need to back up any claims for criminal damage or anything like that.

fantastic, i will bear that in mind, i wont just yank the bloody thing off then!!!! I intend to take pictures, but i was under the understanding that unless he can prove beyond all reasonable doubt that i took it off he cant do anything?and although the assumption is there that it was me, it cant be PROVED?
it belongs to the lease company ? - they are the RK ? As I understand it they cannot clamp it unless the RK is the body the warrant is served against. need a comment from tomtubby on this.
Oh I see! I believe I am the registered keeper at the DVLA, but nonetheless the car is owned ultimately by the finance company surely?Hopefully by tonight this will be irrelevant anyway!
