Default Parking Ticket Not on Car

Afternoon, first post on these great forums!

I've read the templates to send an appeal but none seem to fit my dilema, just got a formal demand before court action.

Just had a nice letter from Central Ticketing stating that i owe them £85 within 28 days. The reason for issue is "Abused Patron Parking" apparentley. I was parked there at the time but i thought it was free parking, its a car park next to a blockbusters and i didn't go into there so i think it was only for blockbuster customers?

Anyway, the letter states that "Please be aware that a parking ticketicon was fixed to the above vehicle and has not been paid. The oppertunity to pay a discounted amount has been lost"

However, there was no ticket on my car at the time and i have never heard from them by post until now. I'm sure that day it was very windy and raining heavily so meybe it blew off or something?

The point im trying to make is that can i appeal to them and tell them that i never recieved the ticket and would it be possible to pay the discounted fine?

What a time of the year to get this crap eh?

    Cheers.

Is this a private ticket we are talking about.
If it is, do not write/phone/pay etc etc.and ignore it.
There are enough posts on this forum to read, and sitckies which explain how to deal with these invoices from these people.

    Welcome to the forums.

Don't let this spoil your Christmas.

These "tickets" that the Central Ticketing have so kindly issued you with are actually invoices for an alleged breach of contract.

Don't try entering into their appeals process as it is laughable. There is no un-biased individual deciding the case. Just a company trying to part you from your hard-earned dosh.

Your best bet is to ignore them. This matter will be decided in the county courticon if it ever gets that far. They have a number of hurdles to clear.

Before they can get you to court they have to establish who breached their alleged contract. They have written a letter to you as the registered keeper of the vehicle. The RK may or may not have been driving - you do not have to supply information as to who is driving. So thats the first hurdle.

Also bear in mind unless the signage is very clear and un-ambiguous and can be easily seen it will be hard for them to prove that their contract was seen and accepted by you.

Also if their terms are unfair the contract will be rendered invalid anyway.

Thats just a few reasons not pay up. Have a read of the Private Parking Charges guide in the stickies.

These companies will try all sorts of threats and final notices to try and intimidate you into paying. They very seldom follow through. There are a number of members who are on to their 3rd of 4th "Final" warning from Central Ticketing. They have yet to see Central Ticketing make good on their threats.

Mostly, when these companies are ignored, they go away and try an easier mark. Central Ticketing do not have a history of litigation so rest easy and enjoy your Christmas. Just ignore them.

"Abused Patron Parking" no such contravention for a real council ticket. Also appalling grammar/use of English. File it in the drawer, ignore it, enjoy Christmas.

    • do not pay
    • do not contact them
    • ignore any future letters
    • they will give up and go away
