    Default Do I have to pay in full?

    In September 2007 I booked a one week cruise with Thomas Cook for October 2007. the day before we were due to leave Thomas Cook called to cancel our cruise due to a problem with the ship. As we had both broken up for work I booked a new holidayicon over the phone with them to leave the following week. They asked for payment for the new holiday and I refused to pay on the grounds that I wanted compensation as I now had holiday money that I needed to change back from Euro's that I would lose money on and I also thought I shouldn't have to pay until I had received my refund from the cruise.

    The lady said she would call me back the following wednesday after 3pm as I should have received my refund by then and she would take payment. I never received a phone callicon and they never took payment for the holiday. A week or so later I received my refund for the cruise but no compensation.

    Yesterday I received a phone callicon from Thomas Cook asking for payment for the holiday I said to the person on the phone not until someone has spoken to me about compensation for the cancelled cruise and the money I lost on exchanging my currency. The guy on the phone jsut said if you don't make payment now we will pass you over to a debt colelction agency when i refused he jsut hung up.

    I have never received any letters requesting payment and heard nothing about this in the past 12 months can they now just refer me to a debt collectionicon agency?

    Any advice would be greatly appreciated.

    yes we did go on the holidayicon and I have no objection to paying for what we had but feel I should be compensated as I had got Euro's for the cruise which I then had to change and lost over £50 on. I also find it frustrating that they can cancel a holiday the day before you are due to go without offering any compensation.

    The only reason they didn't get the payment originally was because they didn't bother to phone me for it I have also never received an invoice for the holiday only the tickets we travelled with.

    Why not make them an offer?

    Tell them your story - tell them that in lieu of compensation for lost holidays due to the lateness of their cancellation you feel you are due £x and you are prepared to pay the holidayicon price - that amount.
