I was clamped this morning (04.45am) although I had the permit on display in the car and I was parked in my allocated spot. I did try to dispute this but the burly guy was having none of it saying it wasn't displayed correctly. I paid cash (£165) which having read through the wiki I now know this to be my first mistake.
The clamper is registered with the SIA (I rang and checked) and works for Redroute, the clamping happened outside my flat on private property.
The question being is there anything I can do and what are the chances of getting my money?
Check the clamping sticky to check that the receipt was correctly issued.
Write asking why they clamped you insisting on a refund. Threaten legal action within, say, 14 days for recovery of the fee plus interest and costs.
If they reject, issue a court claim.
Complain to the land owner.
I would say that based on the "Vine vs Waltham Forest" case your claim should be for wrongful interference with your car based on the fact that it was parked in its allocated space. By virtue of the fact that you displayed a permit (even if it were allegedly displayed "wrongly") you did not consent to the clamping.
If the paperwork is wrong then include this in your claim.
Possibly you need to write to both the clamping company and the owner of the land?
