Oh dear, what did I find on my Abbey loan agreements

I have just discovered that the Abbey applied PPI to three loans I had with them.
The loans were taken out in 1996, topped up in 1997, and again in 1999. It works out from the credit agreements to be approximately with the 3 premiums £7,300.
I do understand that with each top-up, the loan would be cancelled and a portion of ppi and interest would have been credited to the new balance, therefore reducing the amount owed, but I am unaware of the amounts and it does not mention this in the SAR, So I will claim the whole amount, plus 8%interest and let them argue the toss with me
So prelim going off, nothing ventured, nothing gained.

Lets see what they come back withProbably a long delay with a multitude of excuses and a suggestion that you take your complaint to the fos (I notice they never suggest your take your complaint to the local court it is always the FOS as I believe they have to give you this option by law)

Halifax - Full settlement incl interest.
HSBC - Settlement, goodwill no admission of liability about 75% of claim.
RBS - Settlement, goodwill no admission of liability about 70% of claim.
2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
PPI Successes
PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
2 claims settled in full with LV without FOS involvement.
2 claims settled in full with HSBC without FOS involvement
PPI Claims ongoing with:
Cap one Now with the FOS
Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

Natwest Paid me again as GOGW £1,656. Yes they can have it back if they say please.
Barclays 1 Claimed £1,260. Won by default. Paid in full
Barclays 2 Claimed £2,378. Won by default. Paid in full
Birmingham Midshires. Claimed £2,122. Accepted £2,075.

If they mis-sold it, they mis-sold it, regardless on when they did it They have hidden the fact and it has now only come to light with the investigations by the oft and the fsa:grin:

It is amazing when you start to add up the figures and then add on the 8% interest on top and it comes to a staggering £12,995

i am in a similar situation as i have had loans with Blackhorse finance since 2002 and each time i have refinanced with them to clear of one loan with another (the most recent being in 2008). i've already written to them re misselling PPI as it was definately not discussed with me at their offices when i signed the papers, but they are insisting that PPI was explained and agreed for when i signed the loan agreements each time.
I've written 2nd leters to them but i'm still waiting for their responses however, they have offered to cancel the PPI on my most recent loan providing i write and confirm that this is what i want, and they will cancel the PPI from the date they receive my confirmation only.
Can you suggest a stronger letter that i could send to them as i firmly beleive i was and have been mis-sold these PPI but it's difficult to prove. My employers offer generous illness payment packages (full pay for 12 months), redundancy packages also, so i really did not need any PPI.

Ppi claims in general are not the easiest to do, but can be successful:grin: you have to be prepared for them to ignore you, prolong and frustrate matters, deny, refusal etc, etc, what you must show them is that you are serious, you are not going away and will if needed issue court proceeding to resolve your complaint:grin:

This is so true and even when the Financial Ombudsman rules against them they are still paints (this is a colourful expression) in the ass and will not pay back what they have taken in ppi fees. Yes ppi fees that did not need to be applied. The fact I have had now further customer advisor calling since I started my reclaim of PPI is proof of the ripoff. Let them take legal action against me for this post If they can prove it in court then fine but the fact they are offering goodwill gestures with no admission of liablity tells me they will not do this and if they do they will be down a few more quid. I will bet good old Sir Fred will be nowhere to be seen.

Had a letter of response from the Shabbey, they have sent me a ten page template letter, pressed on button and it spewed out the 10 pages.

You give them 14 days and what happens nothing and now they give you an ultimatum on 14 days and what happens? NUCLEAR WINTER if my thinking is correct.
They then further state that if I am using a 3rd party to proceed with my case, a claim company or solicitor, this will not affect my complaint.
They have also provided a sheet relating to PPI on Mortgages, so they must had had a few complaints about this
Will fill it out with the truth and see what enfolds.:grin: You give truth and you will get complete denial in response. This is why the FSA is still having an ongoing battle about mis-sold PPI it is still being MIS-SOLD BIGTIME

Well have heard back from the Abbey regarding my complaint regarding the PPI applied to 3 loans in 1996,1997 and 1999.
To be honest I did not hold out for a easy ride with this one and would get the general fob off letter and have to pursue this one via the courts
Anyway, I was wrong, they have admitted that they could not establish I was provided with sufficent details to be able to make an informed decision when buying these policies and wish to compensate me:grin: with a full refund, plus 8% interest.
They have provided me with calculations regarding the refunds to the new top-up loans and in fact they are correct.
Not quite the £12,000 I was asking for, but a tidy little packet nevertheless.
Acceptance letter winging their way to them.
They have by far been the fairest company I have dealt with so far and fair credit to them
As I stated in a previous post, go for it, you cannot possibly win if you never enter the race :grin:

Thanks for your post, Yes I was rather shocked at the easyness of this claim, thought I was in for the good old fob off from them.
These loans were rather old to say the least.
I will post up more when I have the money The acceptance letter is winging its way to them as we speak
