I set up a HP agreement with Welcome in August 08, I had a car accident on Sept 20th and the car was written off. I was hurt quite badly and haven't been able to work for 3 months. I haven't got the car, didn't get paid out on insurance and have been on SSP for 3 months. I have rung Welcome and explained all this and offered to pay them £50 a month until my circumstances improve. They have declined this. They are since ringing me everyday and also at work. First week back and I am on a warning for personal calls. Saying I have to pay them. Does anyone know what my options are? I don't have another car, nor do I own my own house. I haven't got the money. Do you know what they will do next? Or what I can do. It is beginning to get quite stressful now! I don't know which way to turn.

FORMAL COMPLAINT UNDER THE CONSUMER CREDIT ACT 2006 COMPLAINTS PROCEDURE

I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.
I have verbally requested that these stop, but I am still receiving calls. (Delete if necessary)
I now require all further correspondence from your company to be made in writing only.
I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.
If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.
Please treat this also as a formal complaint, and send me a copy of your company complaints procedure.
Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)
I had the accident the morning after the night before and was just over the legal limit. Hence no payment from Insurance. A piece of toast would have made all the difference ?
I have sent them a letter regarding the calls and also how much I can pay, special delivery and have proof of postage and also a copy of the letter. I sent this today as I got really upset with the 2 calls I received today. If they continue to ring me I will send a copy of that letter - Thank you. I just feel that I have tried to be honest and pay rather than just run away and am some how being punished for it.
i had a car and currently owe £13k to welcome following my fall (broken leg & Ankle ) been off for 18 weeks now and on employment income only ie £94.59 week, first thing is to send to welcome your income details confirming that you can only pay a small amount if its unsecured they may file for a CCJ again send the income details to the court and in most cases the judge will accept your amount, send all letters by recorded mail
