    Default laptop help please!

    hi everyone

    i bought my laptop from currys 9 months ago and it has already broken twice, the most recent problem only being fixed and returned to me on tuesday ..but yet again 2 days later the same problem has occured ..i despretely need my laptop as i have 3 pieces of work in by the start of january so i cant afford to be without it whilst they fart around collecting it, fixing it and sending it back ..is there any way i can demand a new one?

    Hi Bayo

    You have statutory rights under the Sales of Goods Act 1979, and these state that something should be fit for purpose, as described and of satisfactory quality, taking into account the price, brand etc...

    the first time was a problem with the charger, this was a few months ago now ..but the last 2 times has been the screen ..it just goes blank ..the reciept for the last repair says they replaced the lcd invertor ..but the screen has just gone again

    What are you entitled to ask for?
    If the goods are faulty at the time of sale, you are legally entitled to request one of the following remedies:'

    i guess it wasnt faulty when i bought it i cant claim a refund ?

    I would say you can still claim a refund as the goods are not fit for purpose.
    As they are over 6 months old the burden of proof is on YOU to prove that they are not fit, but since the computer has been back in for repair three times in 9 months I would say proving that would be very easy.

    Write to the shop telling them that you are unhappy with the computer and that you feel that it is not fit for the purpose for which it was sold, and that you want a full refund as per the sale of goods act.

    see what their response is.

    Normally a shop will say - write to mfr - not our problem, but since the contract was with them , it is up to them to provide your statutory rights,.
