    Default AA99 v Barclaycard Acc.No.4

    08 Sep I & E sent with covering Hardship Letter offering £20 p.m.

30 October, wrote reminding them of above letter and submitted
SOC requesting refund of all charges dating back to 2004.

Their letter of 7 November confirmed receipt and would reply by 28 November. No response yet

    Hi AA,

    Stick to your deadlines.

Send the lbaicon and updated SOC now, hiding the int't column.

If no reply or refund within 14 days, file at court on this claim.

Thanks Slick, but why do I have to hide the interesticon column and how do I file at court - so weary with it all now........

    Hiya,

When you send the Prelim Letter and lbaicon to BC, you hide the s.69 interesticon column on your SOC because you can only claim this int't when you file at court.

I've told you about filing at court on your other thread.

Thanks Slick, on my way with Accs.2,3&4.

However, my biggest charges claim is with Acc.1 where they said they would reply by 28 Nov and still no news?! Would you mind bouncing in there for me when you can, Cheers

Yes, also feel better for doing that! but ugh, oh, I have always added the interesticon column on my SOC's. Am sure I'd read somewhere that one might as well claim the interest too to start with, they can only deduct it......

I used the little calculator machine off another famous website run by a person who is an avid consumerist himself LOL !

Including the interesticon too is an easy mistake to make....

Received phone callicon today from Barclaycard, could be Acc.1 or 4. She was very pressing, and when I told her I didn't correspond over the phone and was waiting for written replies to my letters, she told me they had the right to phone me every day if they wanted to! As my calls are all recorded, I pleasantly said goodbye

Despite hundreds (literally!) of calls from Mercers, which could or could not be in relation to this account, I have still had no correspondence from BC, I received a letter dated 29 Dec 08 from Mercers being Default notice to pay arrears by 15 Jan 09, which I ignorned.

On 06 Jan, I sent BC an lbaicon plus further SOC (total of which would clear my balance practically) and have still not heard anything

On 23 Jan I received a standard Statement dated 20 Jan saying my acc is seriously overdue and over the credit limit and to please be aware that my card has been withdrawn.

Can/should I make a Formal Complaint to the CEO or maybe phone and record them? The Credit Limit was £300 and the SOC £255

    Angry Re: AA99 v Barclaycard Acc.No.4

So, here we are, 14 months further down the line

This morning I received an 'open' postcard from Risk Management Alternatives which has prompted me to re-bump this thread! I am livid

Time scale since I last posted

25 Jan 09 Letter from Mercers
26 Jan 09 Letter from Mercers
28 Jan 09 phone callicon from Mercers, they offered me 2 x payments and then charges will stop! I referred to my letters of 08 Sep and 20 Oct 2008, and 06 Jan 09, and could they reply in writing please.
29 Jan 09 phone callicon from Mercers, referred to yesterday's conversation and they said those letters are down to BC. Reiterated I wanted a response in writing.
30 Jan 09 phone callicon from Mercers, very rude
11 Feb 09 Phone call from Mercers asking for arrears in full, I referred them to my refund of charges which would clear the balance.
15 Feb 09 Letter from Mercers
05 Mar 09 Letter from Mercers
02 Apr 09 Default Notice from Mercers
10 Apr 09 Letter from Mercers
08 May 09 Letter from BC, balance now over limit, can I pay the overlimit amount?
07 Jun 09 Letter from BC, balance now over limit, can I pay the overlimit amount? (Gone down by £2 now???)
07 Jul 09 Letter from BC, above limit, interesticon added.
06 Aug 09 Letter from BC, even more above limit now.
30 Aug 09 Letter from BC, still haven't had a payment.....
08 Sep 09 Letter from BC, even higher amount over limit now, and don't forget you can't use your card, and you may have to pay other charges if you don't pay something...
23 Sep 09 Letter from BC, urgent payment required, or else.....
    28 Sep 09 I wrote to BC and copied to Reg.Office E14 5HP.
    (attached below)
04 Oct Letter from BC, you are behind with your payments, get your account up to date or we'll instruct Mercers to send you a DN
11 Oct 09 Ack receipt of my letter of 28 Sep 09 and so very sorry to learn of my dissatisfaction, we aim to resolves matters by 29 Oct 09.
19 Oct 09 Default Notice from Mercers
28 Oct 09 Letter from Mercers, we're sending a debt collectoricon round
29 Oct 09 Letter from BC writing further to letter of 11 Oct 09, sorry but cannot provide full response at present, will contact you by 26 Nov 09. Apologies for any inconvenience caused.
18 Nov 09 Letter from Mercers
25 Nov 09 (dated but not recvd!) Letter from BC, you offered £10 p.m. they would accept £7, they can only accept 1% of acc balance, min £5, when they are formally approached by a debt counselling service! Confirmed home phone no. has been removed from database and as a gesture of goodwill, have frozen interest on acc for 3 months!
22 Dec 09 Letter from Power2Contact offering to help
21 Jan 10 Letter from Calders demanding payment of approx.10% of now huge balance.
17 Mar 10 Letter from RMA demanding full balance.

In the meantime, I was paying £7 p.m on 17th of each month (to tie in with benefit payments) started on 17 Feb 09 and paid for 6 months, but stopped after July because charges and interest were still being added so was getting nowhere with balance going down. I haven't even done an update on the phone calls. Fortunately, they're all stored on my recorder
