    Default Car sold with missing documents

    Hi there

    I have just bought a second hand car from a reputable second hand car dealer (if there is such a thing!!) which was sold with a full service history.

    the car is 4 years old with 20k on the clock

    We were given the log book and the service book with the relevant
    stamps which seemed to tally with the mileage of the car. The last service stamp was at 18k miles.

    However when we got the car home we looked more closely at the service history and realised that they had given us a service book for a different vehicle! (same make and model but different Reg)

    We checked with Hyundai head office as they keep a record of all their vehicles service history and it seems the vehicle we had bought had only been serviced once in 4 years at 10k! (not exactly a full service history!)

    When we asked the dealer for the service book for our vehicle we were told they had mislaid it.

    We have now been told that the Hyundai Warranty is invalid if the car has not been serviced every 12 months, and that a full service (including cam belt) is £700.

    Where do we stand in relation to getting the dealer to pay for the service or indeed getting a refund?

    I would say you have a choice - either take the car back and ask for your money back as it was mis-represented as having a full service history,

    you could ask them if they would be prepared to do the service FOCicon (or at a reduced cost) depending on what you want.

    You could even issue on the car dealer for negligent misrepresentation.

    You need to speak to the car dealer in the first instance and see what he is offering - also decide what you want.

    Only when you have a clear idea of these things do you have a point from which you can plan your next move.

    If he has hidden the fact there is no fsi and misrepresented that fact, what else has he hidden about the car!

    If you have the log book, contact the last owner and ask him the mileage that it was sold and if he has the service book.

    Because of the lies in the advertisement, you are entitled to a full refund if you so wish.

    5,000 miles per year (although possible), is very unlikely.

    Thanks for your replies.

    thing is we actually like the car - does anybody know how much a vehicle depreciates without a service history? paid £5600 on an 04 plate.

    We are looking at getting them to refund some cash - have been told we could expect between £1000 and £1500?

    Who said how much you could expect?

    You will be much better off asking for material things rather than monetary. Servicing, tyres, exhaust etc; will get you more than money.

    Whichever way you decide reg, let us know.
